PURDUE UNIVERSITY: ACCEPTANCE OF APPLICATION FOR RENEWAL OF SPECIAL NUCLEAR MATERIALS LICENSE NUMBER 142 ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2023-NFR-0000

Dear Joshua Young:

By letter dated September 18, 2023 (Agencywide Documents Access and Management System (ADAMS) Number ML23268A087), Purdue University (Purdue), in West Lafayette, Indiana, submitted an application, with enclosures, to the U.S. Nuclear Regulatory Commission (NRC) for renewal of special nuclear materials license number 142 (SNM-142). Your submittal was received at the NRC on September 25, 2023.

Following receipt, the NRC staff conducted a review of the application to determine if it contained sufficient technical information in scope and depth for proceeding with its detailed technical review. Based on this review, the NRC staff determined that the application contains sufficient information for proceeding with its technical review. There are a few observations (in paragraph below) for information that the NRC staff could potentially request later. These observations are provided to allow the applicants to start working early on these items. Please note that these observations are not the result of a detailed technical review of the application.

You may supplement your application, if you so desire, before the NRC staff formally makes any requests for additional information.

NRC staff observed that:

  • The material control and accounting (MC&A) portions of the application included outdated regulatory citations (10 CFR Part 74, Material Control and Accounting of Special Nuclear Material, now covers these requirements).
  • The radioactive waste management program at Purdue is tied to the NRCs broadscope license under 10 CFR Part 33 and thus this application should highlight what commitments are needed for the renewal of this Part 70 SNM license.

On November 30, 2023, the NRC staff conducted a conference call with Purdue staff to discuss the observations above and obtain clarification of the information related to these three areas.

Based on the discussions during the call, the Purdue staff identified non-public documents that would provide additional information to address the NRC staff concerns. Following the call, the NRC staff conducted a virtual audit of the documents and determined that they included

J. Young 2 sufficient information to proceed with the detailed technical review; however additional information may still be needed to resolve the observations.

We have completed our acceptance review of your submittal and have identified no administrative omissions or deficiencies that would prevent us from proceeding with a detailed technical review. Your submittal has been assigned Enterprise Project Identification Number L-2023-NFR-0000. Please reference this number and Docket Number 07000152 in any future correspondence associated with this matter.

Please note that the NRC staffs technical review of your submittal may identify issues that could require you to provide additional information. Based on our preliminary evaluation and projection of current review schedules, we anticipate completing our formal review by June 2024. This schedule includes the issuance, if needed, of a request for additional information (RAI) by January 2024, and receiving your responses to the RAI within 30 days of receipt.

Please note that these dates could change depending on the findings of our technical review, urgent assignments, or other factors. Within 30 days after completion of the NRC staff review of your application, a notice will be published in the Federal Register to inform the general public of the NRC staffs decision regarding the application. We will promptly communicate any significant changes to the schedule. The NRC staff estimates that completing the review of the SNM-142 license renewal application will require approximately 600 staff hours. The NRC staff recognizes that as a nonprofit university, Purdue is exempted from licensing fees associated with this action.

Purdue filed the original license renewal application July 21, 2023, at least 30 days before the licenses expiration date of September 25, 2023. Therefore, pursuant to the timely renewal provisions in Title 10 of the Code of Federal Regulations (10 CFR) Paragraph 70.38(a), Purdue is permitted to continue using its SNM in accordance with the existing SNM-142 license, pending final decision by the Commission on the license renewal application. This initial renewal request was submitted within the timely renewal requirements under 10 CFR 70.38(a) but was incorrectly marked. By letter dated September 18, 2023, the application (including all of the enclosures) were re-submitted with the correct security markings and docketed and added to the accordingly (ML23268A087). The staff authored a publicly available internal memo noting the timely renewal status (ML23285A239).

In accordance with 10 CFR Part 2, Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of the NRCs ADAMS. The ADAMS database is accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html.
