U.S. DEPARTMENT OF COMMERCE, NATIONAL INSTITUTE OF STANDARDS AND TECHNOLOGY: ACCEPTANCE OF APPLICATION FOR RENEWAL OF SPECIAL NUCLEAR MATERIALS LICENSE NUMBER 362 (ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2023-RNW-0017)

Dear Dr. Mackey:

By letter dated August 8, 2023 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML23220A398), the U.S. Department of Commerce, National Institute of Standards and Technology (NIST), in Gaithersburg, Maryland, submitted an application, with enclosures, to the U.S. Nuclear Regulatory Commission (NRC) for renewal of special nuclear materials license number 362 (SNM-362), for the NIST. The NRC received your submittal on August 10, 2023.

Following receipt, the NRC staff conducted a review of the application to determine whether there were any administrative omissions or deficiencies that would prevent us from accepting it and proceeding with a detailed technical review. During this review, the NRC staff identified information within certain technical areas that needed clarification. These areas were:

transportation security, physical security, and waste management. As such, on September 21, 2023, the NRC staff conducted a conference call with NIST staff to discuss the identified issues and obtain clarification of the information related to these three areas. Based on the discussions during the call, the NIST staff identified non-public documents that would provide additional information to address the NRC staff concerns. Following the call, the NRC staff conducted a virtual audit of the documents and determined that they included sufficient information to proceed with the detailed technical review.

We have completed our acceptance review of your submittal and have identified no administrative omissions or deficiencies that would prevent us from proceeding with a detailed technical review. Your submittal has been assigned Enterprise Project Identification Number L-2023-RNW-0017. Please reference this number and Docket No. 07000398 in any future correspondence associated with this matter.

E. Mackey 2 Please note that the NRC staffs technical review of your submittal may identify issues that could require you to provide additional information. Based on our preliminary evaluation and projection of current review schedules, we anticipate completing our formal review by July 2024.

This schedule includes the issuance, if needed, of a request for additional information (RAI) by December 14, 2023, and receiving your responses to the RAI by January 23, 2024. Please note that these dates could change depending on the findings of our technical review, urgent assignments, or other factors. Within 30 days after completion of the NRC staff review of your application, a notice will be published in the Federal Register to inform the general public of the NRC staffs decision regarding the application. We will promptly communicate any significant changes to the schedule. The NRC staff estimates that completing the review of the SNM-362 license renewal application will require approximately 820 staff hours which corresponds to about $246,000.00 ($300.00/hour). We will promptly communicate significant schedule or cost changes, if any.

The NIST filed its license renewal application at least 30 days before the licenses expiration date of September 9, 2023. Therefore, pursuant to the timely renewal provisions in Title 10 of the Code of Federal Regulations (10 CFR) Paragraph 70.38(a), NIST is permitted to continue using its SNM in accordance with the existing SNM-362 license, pending final decision by the Commission on the license renewal application.
