Dear Dr. Banovic:
This is in response to your submittal, with Enclosures, dated August 8, 2023 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML23221A162) requesting the U.S. Nuclear Regulatory Commissions (NRCs) renewal of special nuclear materials license number 362 (SNM-362), which authorizes the U.S. Department of Commerce, National Institute of Standards and Technology (NIST), to possess and use SNM, for a period of ten years. The license renewal application (LRA) was submitted pursuant to the requirements in Title 10 of the Code of Federal Regulations (10 CFR)
Part 70. Your submittal was later supplemented by letter, and Enclosures, dated March 11, 2024 (ML24071A178).
The NRC staff has completed its review of your submittal and supplemental letter. Based on its review of the information provided, the NRC staff found that NISTs program under SNM-362 will provide adequate protection of public health and safety and that the LRA, and supplemental information, meets the requirements of 10 CFR 70.23, Requirements for the approval of applications. The NRC staff recommended that NISTs SNM-362 license be renewed for a 10-year term and, therefore, pursuant to the requirements in 10 CFR Part 70, the NRC is renewing the SNM-362 for a 10-year term, expiring on April 10, 2035.
Renewal of SNM-362 meets the regulatory requirements under 10 CFR 51.22(c)(14)(v) for a categorical exclusion not requiring the NRC to conduct an environmental review under the National Environmental Policy Act because this licensing action concerns the use of radioactive materials for research and development.
Enclosed please find public version of the NRC staffs safety evaluation report (SER)
(Enclosure 1), the public version of the renewed SNM-362 (Enclosure 2), the non-public SER (Enclosure 3), and non-public version of the renewed SNM-362 (Enclosure 4).
Documents transmitted herewith contain Security-Related Information.
When separated from Enclosures 3 and 4, this letter and Enclosures 1 and 2 are decontrolled.
