FORT CALHOUN STATION, UNIT NO. 1 ACCEPTANCE OF REQUESTED LICENSING ACTION RE: LICENSE AMENDMENT REQUEST TO ADD LICENSE CONDITION TO INCLUDE LICENSE TERMINATION PLAN REQUIREMENTS (EPID L-2021-LIT-0000)

By letter dated August 3, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21271A178), as supplemented by letter dated January 13, 2022 (ADAMS Accession No. ML22034A602), Omaha Public Power District (the licensee) requested the U.S. Nuclear Regulatory Commission (NRC) to approve a request to add a condition to include License Termination Plan (LTP) requirements to the NRC license for Fort Calhoun Station, Unit 1 (FCS).
The FCS LTP provides the details of the plan for characterizing the site, identifying remaining dismantlement activities, and remediating the remaining residual radioactivity at FCS to a level that complies with the NRCs radiological criteria for license termination. The FCS LTP also describes how the licensee will confirm the extent and success of remediation through radiological surveys, provide financial assurance to complete decommissioning, and ensure the environmental impacts of the decommissioning activities are within the scope originally envisioned in the associated environmental documents.
The proposed amendment would approve the LTP and add License Condition 3.D that establishes the criteria for determining when changes to the LTP require NRC approval. The LTP will be implemented by the licensee to complete decommissioning activities at the FCS site. Once decommissioning is complete, a separate request will be made to the NRC by the licensee to terminate the FCS license.
The purpose of this letter is to provide the results of the NRC staffs initial administrative and acceptance review of the submittal. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC has reviewed your application as supplemented and concludes that it does provide technical information in sufficient detail to enable the NRC to complete its detailed technical review and make an independent assessment regarding the acceptability of this request in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRCs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed to address these areas, you will be advised by separate correspondence.
Based on the information provided in your submittals, the NRC staff has estimated that this licensing request will take approximately 3000 hours0.0347 days <br />0.833 hours <br />0.00496 weeks <br />0.00114 months <br /> to complete. The NRC staff expects to complete this review in approximately 24 months from the date when the application was accepted into ADAMS, which was September 28, 2023. If there are emergent complexities or challenges in our review that would cause changes to the initial estimated completion date, the reasons for the change, along with a new estimate, will be communicated during the routine interactions with the project manager. This estimate is based on the NRC staffs initial review of the application and it could change, due to several factors including requests for additional information, unanticipated addition of scope to the review, and review by NRC advisory committees or hearing-related activities.
In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs Agencywide Documents Access and Management System (ADAMS).
