CLINTON POWER STATION - FINAL SIGNIFICANCE DETERMINATION FOR A SECURITY-RELATED PRELIMINARY GREATER THAN GREEN FINDING WITH ASSESSMENT FOLLOW-UP; NRC SECURITY INSPECTION REPORT 05000461/2020404

Dear Mr. Hanson:

This letter provides the results of our significance determination of the preliminary Greater than Green finding identified in our previous communication dated September 3, 2020, which included Inspection Report No. 05000461/2020403 (Non-Public). This preliminary finding was discussed in detail in Section 93812 of the inspection report.

In our September 3, 2020 letter, we provided you the opportunity to attend a regulatory conference or provide a response in writing to the preliminary finding. In a telephone conversation with Mr. Steven Orth of NRC, Region III, on September 9, 2020, and in a subsequent letter dated September 10, 2020, your staff indicated that you did not contest the characterization of the risk significance of this finding and that you declined the opportunity to discuss this issue in a Regulatory Conference or to provide any additional written response.

After considering the information developed during the inspection and the information provided in your staffs letter dated September 10, 2020, the NRC has concluded that the finding is appropriately characterized as Greater than Green, a finding with greater than very low security significance. The specific details concerning the security significance of this finding are described in Inspection Report No. 05000461/2020403 (Non-Public). At this time, we have not completed our determination of any enforcement associated with the finding. We will communicate that decision in a subsequent correspondence.

According to NRC Inspection Manual Chapter (IMC) 0609, appeal rights only apply to those licensees that have either attended a regulatory conference or submitted a written response to the preliminary determination letter.

As a result of our review of Clinton Power Stations performance, including this finding, we have assessed the Clinton Power Station to be in the Regulatory Response column of the NRCs Action Matrix, effective the third quarter of 2020. Therefore, we plan to conduct a supplemental inspection using Inspection Procedure 95001, Supplemental Inspection Response To Action Matrix Column 2 Inputs, when your staff has notified us of your readiness for this inspection. This inspection procedure is conducted to provide assurance that the root cause and contributing cause of risk significant performance issues are understood, the extent of condition and the extent of cause are identified, and the corrective actions are sufficient to prevent recurrence.

In accordance with Title 10 of the Code of Federal Regulations (CFR) 2.390 of the NRC's Rules of Practice, a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room or in the NRCs Agencywide Documents Access and Management System (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html. If you choose to respond and Security Related Information is necessary to provide an acceptable response, please mark your entire response Security-Related Information in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1).
