APPLICATION OF THE NRC STAFF FOR ISSUANCE OF A SUBP0ENA Pursuant to i 161c of the Atomic Energy Act of 1954, as amended, 42 U.S.C. 5 2201(c), and 10 C.F.R. 5 2.720(a) of the Commission's regulations, the Staff of the Nuclear Regulatory Commission (Staff) i applies for issuance of the attached subpoena. The subpoena would require the named individual to appear and testify and to produce evidence in the l incaring in this matter which is scheduled to begin on May 24, 1989.

f The inoividual named in the attached subpoena is an employee of the j

Southern California Edison Company (SCE), the Licensee of the San Onofre Nuclear Generating Station. Mr. Talley, se individual named in the subpoena, is in charge of ICE's substance abuse program. As set forth in I

l the attached subpoena, Mr. Talley would testify as to SCE's policies concerning the use of controlled substances, how these policies are implemented by SCE and the actions taken with respect to Mr. Acosta after each of his positive drug tests. These matters are relevant to the subject matter of this proceeding, and thus, this request for issuance of a subpoena to require Mr. Talley to testify and produce documents is in compliance with 10 C.F.R. 6 2.720(a) of the Commission's regulations.
