  • above-captioned proceeding, the Licensing Board gave the parties an opportunity to discuss the possibility of settling this matter. Tr. 52-53. The Staff reported to the Licensing Board that the parties needed more time to explore the settlement possibilities. Tr. 53. Staff counsel agreed to file a report of the status of negotiations by November 4,1988. Id.

At Mr. Acosta's request, and with the agreement of the Staff, 2e Licensing board delayed the comencement of discovery until that date. Tr. 54-55.

The Staff has spoken with Mr. Acosta, who has expressed his willingness to reach a negotiated settlement of this mattsr if possible. The Staff, however, believes that there is no basis for settlement of this matter.

The Staff has comunicated its position to Mr. Acosta. The parties intend to proceed with the hearing schedule adopted by the Licensing Board in its Memorandum of October 21, 1988.
