AUG 2 1989 ENCLOSURE 1 NOTICE OF VIOLATION North Carolina State University Docket No. 50-297 Raleigh, NC License No. R-120 During the Nuclear Regulatory Commission (NRC) inspection conducted on June 28-30, 1989, violations of NRC requirements were identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1989), the violations are listed below:

A. 10 CFR 19.12 requires the licensee to instruct all individuals working in or frequenting any portion of the restricted area in the health protection problems associated with exposure to radioactive material or radiation, in precautions or procedures to minimize exposure, and in the purpose and functions of protective devices employed, individuals' responsibilities and the availability of radiation exposure reports which workers may request pursuant to 10 CFR 19.13.

Contrary to the above, as of September 26, 1988, the licensee failed to instruct all individuals working the restricted area in that, no training covering all the subjects required by 10 CFR 19.12 was given to the Radiation Protection Office personnel who routinely perform surveys in the reactor facility.

This is a Severity Level IV violation (Supplement IV).

B. Technical Specification 6.3.a(8) requires operating procedures to be written, updated periodically and followed for radiation control. ,

Environmental Radiation Surveillance Report and Analysis Procedures, in use prior to April 1989, require that millipore filters from air samplers located on the rooftops of various buildings on campus, including the Riddick Engineering Building, be collected weekly and analyzed for gross beta activity and that milk samples from specified locations be collected monthly and analyzed for Strontium-90 activity.

Environmental Procedure ERS-MP, Rev. 0, Millipore Filters, dated April 28, 1989, requires that millipore filters from air samplers located on the 3 rooftops of various buildings on campus, including the Riddick Engineering i Building, be collected and analyzed weekly to determine the gross alpha j and beta activity.

l Contrary.to the above, the licensee failed to comply with the.

requirements-of these procedures in that:

1. 'From February 28, 1989 through May 30, 1989, no sample was collected _ .

from the air sampler located on the rooftop of the Riddick Engineering Building and no analysis was made to determine the gross alpha and/or beta activity; and,

2. During July 1988, and.from October through December 1988, and from January through March 1989, no milk. samples were collected and/or analyzed for Strontium-90 activity.

This 'is a Severity Level IV violation (Supplement IV).

E Pursuant to the provisions of 10 CFR 2.201, North Carolina State University is hereby required to submit a written statement or explanation to'the ' Nuclear Regulatory Commission, ATTN: Docueent Control ~ Desk, Washington, DC 20555, with a copy to :the Regional Administrator, Region II, within 30 days of the date of the . letter transmitting this Notice. This reply should be clearly marked as a " Reply to a Notice of Violation" and should include [for each violation]: (1)-admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given tu extending the. response time. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.
