APPENDIX A NOTICE OF VIOLATION North Carolina State University Docket No. 50-297 PULSTAR Research Reactor License No. R-120 As a result of the inspection conducted on March 15-19, 1982, and in accordance with the NRC Enforcement Policy, 47 FR 9987 (March 9,1982), the following violations were identified.

A. 10 CFR 50.54k requires that an operator or senior operator licensed pursuant to Part 55 be present at the controls at all times during the operation of the facility. Technical Specification 1.4 defines operation as any condition when the reactor is not secured. Technical Specification 1.3.b requires, as a condition for reactor secured, that power to the control rod magnets and actuating circuits be switched off and the console key removed.

Contrary to the above, a licensed individual was not at the controls during the night of March 11-12, 1982 when the console key was left in the lock and ON with the control room unattended and locked for approximately six hours.

This is a Severity Level V Violation (Supplement I.E.).

B. Technical Specification 6.2.7 requires that the Reactor Safeguards Advisory Group (RSAG) shall meet at least every six calendar months.

Contrary to the above, RSAG meetings were not held at least every six calendar months in that, no meetings were held in the intervals of August 7, 1978 to April 15, 1978 and November 19, 1980 to March 19, 1982.

This is a Severity Level V Violation (Supplement I.E.).

Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including: (1) admission or denial of the alleged viola-tions; (2) the reasons for the violations if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown.
