(Beaver Valley Power Station, ) Facility Operating Unit No. 1) ) License No. DPE-66 LICENSEES' RESPONSE TO REQUEST AND PETITION OF PENNSYLVANIA PUBLIC UTILITY COMMISSION By Order dated March 13, 1979, the Commission ordered the Beaver Valley facility to be placed in a cold shutdown condition. The Order also afforded interested persons the opportunity to request a hearing on the issue of whether operation of the plant should be suspended until certain seismic analyses and modifications related to piping systems have been completed.
In response to that Order, the Pennsylvania Public Utility Commission (" Peti tioner" ) , on April 2, 1979, filed a request for a hearing and petition for leave to intervene.
Petitioner stated its concerns that the ordered shutdown will result in substantial increases in the cost of electricity, may result in unjust and unreasonable rates, and may jeopardize the continued supply of safe, adequate, (s 79$53f$l$y

a and reliable electric service in Pennsylvania. On April 10, Petitioner amended its petition to state that it was re-questing a hearing only if one or more of the following conditions should exist:
(a) any other party is granted hearing; (b) it is determined by the staff of the Nuclear Regulatory Commission that an extended period of cold shut down for Beaver Valley No. 1 shall be necessary in order to make safety related modifi-cations; (c) the Nuclear Regulatory Commission Staff determination vis-z-viz the shut down at Beaver Valley No. 1 is not forthcoming within a reasonable period of time.
Because none of the three events has occurred, it is clear that Petitioner is not presently asking for a hearing. Licensees therefore suggest that the Commission hold in abeyance its ruling on the matter until such time as Petitioner notifies the Commission that one or more of the events has occurred.
