NOTICE OF VIOLATION (Inspection No. 50-219/88-33)
This letter refers to the' routine safety inspection conducted on October 30
through' December 3,1988, at the Oyster Creek Nuclear Generating Station,
,
Forked River, New Jersey. The inspection report was sent to you on
January 19, 1989. During this inspection, violations of NRC physical protec-
tion requirements were identified by the NRC.
The violations, which are des-
cribed in the enclosed Notice of Violation, involved a degradation of .s vital
area (VA) barrier. and a failure to notify the NRC Operations Center within
one hour of being informed of the identified degradation by the NRC inspector.,
The vital area barrier was degraded for approximately 34 hours3.935185e-4 days <br />0.00944 hours <br />5.621693e-5 weeks <br />1.2937e-5 months <br /> because temporary
scaffolding and cabling was erected in a section of the reactor building in
preparation-for maintenance, and this temporary equipment provided a path
through which unauthorized and undetected access could be gained from a pro-
tec.ted area .into a vital area. This violation is classified at Severity
Level IV in accordance with Section D.7 of Supplement III of the " General State-
ment of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2,
' Appendix C'(Enforcement Policy) (1988) because the degradation was not easily
exploitable in that (1) the access pathway was a temporary structure whose
configuration was such that actual access to the vital area was difficult;
-(2) the degradation did not exist for a long period; and (3) the access was
hazardous in that it involved use of an electrical cable for support over an
open area with a potential fall of one hundred feet.
Notwithstanding this classification at Severity Level IV, the NRC is concerned
that the degraded barrier existed in an area that was subject to routine tours
by security and supervisory personnel, yet the degradation was not identified.
' Further, operations personnel did not identify this condition although they
are required to look for abnormal conditions.
This violation demonstrates the
importance of plant personnel remaining alert to the potential impacts on
security requirements during the performance of daily maintenance and opera-
tional evolutions. Therefore, we emphasize that any similar violations in the
future may result in escalated enforcement action. The other violation described
in.the enclosed Notice is also classified at Severity Level IV.

preparing your response, you should follow the instructions specified in the
enclosed Notice.
In your response, you should document the specific actions
taken and any additional actions you plan to prevent recurrence.
Further, you
should place all Safeguards Information (as defined in 10 CFR 73.21) in an
enclosure, so as to allow your letter, without the Safeguards Information, to
be placed in the Public Document Room.
Afcer reviewing your response to this
Notice, including your proposed corrective actions, the NRC will determine
whether further NRC enforcement action is necessary to ensure compliance with
NRC regulatory requirements.
The enclosed Notice contains details of your security program that have been
determined to be exempt from public disclosure in accordance with 10 CFR 73.21
(Safeguards Information).
Therefore, those portions will not be placed in the
NRC Public Document Room and w'll receive limited distribution.
This letter
will be placed in the Public Document Room in accordance with 2.790(a).
The response directed by this letter and the enclosed Notice is not subject to
the clearance procedures of the Office of Management and Budget as required by
the Paperwork Reduction Act of 1980, PL 96-511.
