ALLEGATION NO. RI-85-A-0095 (Hope Creek)
On August 27, 1935, an alleger provided a series of concerns relating to I&C testing to S. Cnaudhary and J. Lyash in the NRC Resident Inspector's office at the Hope Creek Generating Station. He further stated that he had received a warning from his supervisors that he would be fired from his job if he went to the NRC with these concerns.
By letter dated September 6,1985, NRC Region I related the technical concerns to the licensee and requested a response. The licensee responded in a letter dated October 24, 1985. Copies of both letters are attached. The licensee's response indicates that the alleger had also brought these and other concerns to the attention of the licensee's SAFETEAM organi: a: ton. Some of the allega-tions were substantiated by the licensee's investiga: ion, but had previously been identified for resolution by the established review system on site. Other items were not substantiated, and a few resulted in r.ew corrective actions based on SAFETEAM review.
Since real problems did exist with regard to the test procedures in question, another letter, dated January 8,1986, requested the licensee to review generic implications of the findings. A response, dated March 21, 1986, describes controls addressing the concerns and concludes that no generic implications result. Copies of both letters are also enclosed.
With regard to the demotion of the alleger, he was referred to DOL by our letter dated September 6, 1985. An October 18, 1985 letter from the DOL Area Director finds in favor of the alleger, stating that discrimination was a f actor in the employer's decision to demote him. This decision was appealed and went to a hearing. A March 21, 1986 Decision and Order from the ALJ also finds for the alleger. This decision is currently under review by the Secretary of Labor.
Related to this set of allegations, the Office of Investigations conducted an inquiry (Q-1-65-018) to determine if any records associated with the concerns had been falsified. The conclusion was that no evidence of falsification was found. ,
