SUBJECT:

CONTROL OF NRC RULEMAKING: RES REVIEW OF ONGOING NMSS-SPONSORED RULEMAKING Based on our review of the ongoing NMSS-sponsored rulemaking, " Uranium Mill Tailings Regulations: Ground Water Protection and Other Issues," RES recomends that NRC should continue this specific ongoing rulemaking.

The basis for our recomendation is as follcws:

o The Comission has instructed the staff to continue to develop regulations to implement the EPA mill tailings standards for ground water protection.

o The action proposed by HMSS--to insert the clearly nondiscretionary ground water protection provisions of the EPA standard in Part 40--is a cost-effective way of carrying out the Comission's directive.

The com lete RES independent review package has been sent to OE00 (Attention:

DEDROGR and to the Directors of IE and NMSS.
