Maintenance / Equipment Staging Building - McGuire Nuclear Station Units 1 and 2 By letter dated May 4,1987 you submitted a report pursuant to Technical Speci-

fication 6.15 regarding the Maintenance / Equipment Staging Building recently -

constructed at the McGuire Nuclear Station Unit 2.

The submittal includes a sumary of your 10 CFR 50.59 evaluation from which you.have determined that.

the new facility may be utilized without prior NRC approval. The submittal diso notes your intention to Commence utilization of the new facility on May 15,:

-4 1987, and requests NRC staff response prior to that time.

We find that utilization of the Building represents a new radiological environ-ment under significantly changed circumstances from those described.in the-Safety Analysis Report as previously reviewed. including new locations' for effluents released to unrestricted areas. Moreover, several changes to Technical Specifi-cations (TS) are required prior to utilization,'in:luding TS Figure 5.1-3, and Tables 3.3-13 and 4.3-9.

Accordingly, utilization of the facility requires prior Commission approval.

During its review the staff considered the basis for your positior, that TS changes are not required. You cite a previous event involving operation with a reconsti-tuted demonstration fuel assembly which omitted one fuel' rod as a precedent from which you conclude that the maintenance of Chapter 5 of the TSs_ in a timely manner i

is of no ooerational concern. This; conclusion -is a non sequitur,'and is in-consistent not only with the Comission's regulations, but also with several i

related and subsequent staff actions associated with McGuire Amendments 58/39, I

60/41 and 68/49. You also cite the Commission's Interim Policy Statement on Tech-nical Specification Improvements which discusses removal'of Radiological' Environmental TSs and you acknowledge that an amendment toL10 CFR 50.36a must' preceed such removal. We note that 10 CFR 50.36a is not scheduled to be-amended -

l prior to May 15, 1987, and that pending issuance of such amendment, the changes to:

TSs on effluents due to the Maintenance / Equipment Staging Building continue to be -

necessary..
