COMMENTS ON THE PROPOSED RULE-ELECTRONIC AVAILABILITY OF NRC PUBLIC RECORDS AND ENDING OF NRC LOCAL PUBLIC DOCUMENT ROOM PROGRAM i am responding to your memorandum of April 14,1999, in which you commented on the subject proposed rulemaking.
Comment: "On pages 13,39, and 46 (the new definition of the Public Document Room) please add "6 months after successful" as per the attached."
Resoonse: The definition of the PDR as now written is misleading. The paper and microfiche records that are in the NRC Public Document Room (PDR) at the time that ADAMS is implemented will remain there. To clarify the definition of the PDR, we propose to reword the first sentence as follows:
NRC Public Document Room means the facility at 2120 L Street, NW., .
I Washington, D.C. where certain public records of the NRC that were made available for public inspection in paper or microfiche prior to the implementation of the NRC Agencywide Documents Access and Management System, commonly referred to as ADAMS, wi!! remain available for public inspection. l l
Comment: "On page 27 should we not state that we will charge " current rates" rather than to i specify a number in a rulemaking?"
Response: The Freedom of Information Act (5 U.S.C. 552(a)(3)(A) and (4)(A)(i)) requires each agency to publish its schedule of fees for making copies of its records available to the public.
The PDR publishes its fee schedules in this section of the regulation, and the only change that l the proposed rule makes to this section is to change the term "Public Document Room" to read "NRC Public Document Room." NRC was added to the term throughout the regulation. All other wording remains as currently published in the regulations.
