Dear Senator Cranston:

I am responding to the letter of your constituent Ms. Helen Kingsbury in which she expressed her view that reinstatement of the low power l'icense for Diablo Canyon, Unit 1 should be delayed until completion of the forth-coming hearing on design quality assurance. As you are aware, in an enforcement action on November 19, 1981, the Comission suspended the authority to load fuel and conduct low power testing which is granted under the Diablo Canyon low power license. At the same time the Comission and the NRC staff required of the licensee, Pacific Gas & Electric Company, that an independent design verification program be conducted. This effort has been underway for nearly two years and is ~now coming to completion. The staff issued a safety evaluation of the entire program on August 5,1983 and a second evaluation on October 14, 1983 rel,ating specifically to those matters that must be resolved prior to restoration of the suspended authority to load fuel under the low power license. Copies of both reports are enclosed. The Commission has scheduled a meeting in Washington, D. C. on October 28, 1983 to hear from the staff and all parties to the Diablo Canyon proceeding. As we have stated frequently, the authority to load fuel and conduct cold system testing will not be reinstated until such time that the commission is satisfied that those matters which gave rise to the suspension of that authority have been adequately resolved. In parallel with, but separate from, the enforcement proceeding and the consideration of reinstatement of the suspended license authority, a hearing will be held before the NP.C Atomic Safety and Licensing Appeal Board on matters of design quality assurance. This hearing, which is being held in the course of the Appeal Board's evaluation of the application for a full power license, is scheduled to commence on October 31, 1983 in the San Luis Obispo area. x

Dear Mr. Martin:

This letter responds to observations reported in Open Item No. 83-28-02 of NRC Inspection Report Nos. 50-275/83-28 and 50-323/83-20, dated September 22, 1983,, covering the period of July 31 to September 3,1983. PGandE believes that a professional atmosphere exists in the control room among the shift operating personnel. PGandE has always required that activities in the control room be conducted in a businesslike and professional manner. A May 26,1981 memorandum from the Supervisor of Operations to the - shift foremen treated this subject in detail. At the time of the inspection, there was substantial construction activity in most areas of the plant, including the control room. The facility was not " ready to load fuel" during the inspection period. Once fuel load begins, only a small controlled number of contractor personnel will be I pennitted into the control room for Unit 2 modifications. The NRC inspector listed four specific areas where improvement is expected. These four expectations are addressed in the enclosure. ! ENCLOSURE y                                       RESPONSE TO INSPECTION OPEN ITEM 83-28-02 PGandE's response to each of the NRC inspectors' numbered " expectations" under Open Item 83-28-02 is headed by the text from Inspection Report Nos.

50-7.75/83-28 and 50-323/83-20, page 2.

prior to fuel load. Work required for low power testing and power ascension will continue during and after fuel loading.

A's discussed by Mr. R. C. Thornberry at the September 7,1983 meeting with the NRC, Nuclear Plant Operations will control construction activities for Unit 1 (and Unit 2 as necessary). The license and Technical Specifications require that Nuclear Plant Operations have control and responsibility for all activities in Unit I which could affect plant operation or safety, including any Unit 2 activities that could affect Unit 1. This has recently been re-emphasized in the attached memo addressed to the Onsite Project Completion Manager and the Plant Manager.

                        "(3) the plant to be cleared and free of fire hazards,"                          ~

With the considerable decrease in construction activity, a major program is now in progress to improve plant cleanliness and eliminate fire hazards. The purpose of this program is to eliminate fire hazards by fuel load.

                        "(4) operation's personnel in positions of clearly identified authority."

A crew roster has been placed on the wall of the control room. The roster lists the names of the Shift Foreman, the Shift Technical Advisor, ! the Senior Control Operator, the Control Operator, and the Assistant l Control Operator for each unit. These individuals can be easily i .

Project Organization As the time nears for fuel loading on Unit 1, we believe it desirable to reiterate the division of onsite responsibilities between the Nuclear Plant Operations Staff and the Onsite Project Organization in order to provide assurance that Unit I will be operated in accordance with the operating license requirements.

As required by the Unit 1 License and Technical Specifications, Nuclear Plant Operations is responsible for overall operation of Unit 1, particularly for all activities that could affect safe operation, including any Unit 2 activities that could affect Unit 1. As such, the Plant Manager has overall responsibility for the conduct of fuel load, startup, and power ascension activities. The Plant Manager has the authority and responsibility to control and/or terminate any activities at any time that have the potential for , adverse impact on plant safety or personnel safety. He may delegate this authority to other members of the plant staff (such as the Plant Superintendent, and the on duty Shift Foreman) as necessary. As called for in the PGandE/Bechtel contract, the overall setting of priorities and programs through Commercial Operation is the responsibility of i Bechtei and the Project organization. However, such priorities and programs l must be coordinated through the Plant Manager, such that he can exercise his l responsibility to assure safe operation. All Design C'hange Notices for Unit I and for Unit 2 systems which could impact Unit 1 must be submitted for PSRC review and approval. Nuclear Plant i Operations has the option of completing the work using members of the plant staff or delegating responsibility for the work to the Onsite Project Organization. ! To assure that Nuclear Plant Operations is in control of Unit 1, plans for all construction activities affecting Unit 1 must be submitted to Nuclear Plant Operations for their written approval prior to starting the work. The method for obtaining this approval is documented in applicable procedures issued by the Plant Manager. 0013cg l

The Onsite Project Organization is responsible for the construction activities on Unit 2, and the remaining modification work on Unit I under the Nuclear Plant Operations controls as previously mentioned. With this division of responsibility, Nuclear Plant Operations should interface with the NRC onsite on matters affecting Unit 1, and the Onsite Project Organization should interface with the ,NRC,onsite on matters affecting Unit 2.
