Dear Mr. Strumwasser:

As we've recently discussed, copies of security materials regarding the Diablo Canyon facility have been maintained for the use of' the Governor in the Comission's Willste Building in Silver Spring, Maryland. The security aspects of the Diablo Canyon proceeding have been concluded for some time now. I have been infonned that the room in which these materials are being stored has suffered some water damage and requires repair. In addition, the space is needed for other agency purposes. Efforts to find a new suitable location for the continued storage of these materials have been unsuccessf.ul. Accordingly, I must ask that you promptly make appropriate arrangements for the removal and storage of all materials that we are presently storing for the Governor. I would refer you to ALAB-600,12 NRC 3 (1980) which may provide some useful guidance to you. If suitable arrangements are not made by July 15, 1983, the materials will be destroyed. He recently received the attached letter dated June 23, 1983 from J. R. Reynolds, Counsel to Joint Intervenors, to H. R. Denton, Director of HRR. The letter relates to an IDVP meeting with the PG&E Diablo Canyon Project on June 14, 1983. The dRC was not represent' d at the meeting. Among other items the resolution e of E01 File 1132 was discussed. According to the enclosed letter this discussion did not only pertain to the technical aspects of the E01, but also to the procedure for identification and resolution of the issue. In particular the letter raises a question concerning the independence of the IOVP in its inter-actions with the Project. We request that you detennine and fully assess the factual circumstances of the IDVP interaction with the Project at the meeting. This thould be based solely on information from IDVP participants. You should specifically evaluate the events with respect to any actual or apparent influence from the Project on the IDVP representatives. We also request that you determine and evaluate to what extent, if any, similar circumstances arose at other 10VP/ Project meetings and what overall effect such conditions could have on the IDVP. l Since the Independent Design Verification Program ("IDVP") for Diablo Canyon Nuclear Power Plant ("Diablo Canyon") was instituted by the Commission eighteen months ago, the question of the independence of the auditors has been a continuing concern of the Joint Intervenors and other interested parties. Without such independence, the audit and its findings will do little to restore lost public confidence in the design and construction of Diablo Canyon and the effectiveness of the commission's licensing review process. I-am writ.ing on behalf of the Joint Intervenors to relate to you a discussion at a recent IDVP meeting which provides disturbing evidence of Pacific Gas and Electric Company's ("PGandE") continuing failure to appreciate either the meaning i of or the necessity'for such independence. Specifically, our i i concern arises out of the June 14, 1983 meeting at PGandE's offices in San Francisco between the Diablo Canyon Project ("DCP" or " Project") (the PGandE/Bechtel licensing team) and 4 the IDVP regarding the status of certain Error Open Items ("E0I"), in particular E0I File No. 1132 (Auxiliary Building Corrective Action Program). l l The EDI in question (a copy of which is enclosed) concerns j the DCP's failure to report that auxiliary building slabs at Diablo Canyon have not been qualified for in-plane loadings, i despite the fact that the joint DCP/IDVP Schedule, EPS-616A Revision 3, dated May 16, 1983 (" Schedule"), clearly stated W > hat the DCP has completed auxiliary building member i t l _ y n e, y 7 7 (

l i evaluations. This error was further compounded by the PGandE Final Repogt,,,May 18, 1983 (" Final Report"), which also implied that these evaluatl'ons were complete. The significance of this discrepancy,-according to EOI 1132, is that " required corrective action was not fully implemented, yet reported as complete." + In a discussion among Dr. Robert L. Cloud and Edward 1 Denison of the IDVP (Robert L. Cloud and Associates ("RLCA")) and Gary Moore of the.DCP, Dr. Cloud defendgd the issuance of the EOI, explaining that although the Final Report might be a i subject to differing interpretations regarding qualification of the slabs, the Schedule unequivocally stated that all member evaluations were complete when in fact they were not. On that basis, he concluded that the EOI was appropriate. 'his brought a heated response from the DCP's spokesman, Mr. hvore, who focused on the fact that "certain parties" might i try to use this sort of report as an indication that the DCP t l was trying to cover up its failure to qualify the slabs. During this exchange, which lasted the better part of an hour, j Mr. Moore and other members of the DCP repeatedly urged Dr. Cloud to consult with them before committing this type of EO7 to paper. They further stated that 1.1 RLCA had done so in 2 this instance, the DCP would have made clear that it had not j yet completed its evaluations of the slabs for in-plane loadings, and hence an EOI would have been unnecessary. l In addition to pressing RLCA to consult with the DCP prior to issuing its EOI's, Mr. Moore strongly urged Dr. Cloud to i alter the language of the " Significance of Concern" item in EOI l 1132. The DCP's position was that the EOI should simply state l that the slabs were not yet qualified for in-plane loads, omitting all references to the inaccurate statements in the Schedule and the misleadin'g nature of the Final Report. I Clearly responding to considerable pressure, Dr. Cloud ultimately agreed to reconsider the language of the EOI. l Furthermore, Mr. Ron Wray of Teledyne Engineering Services ("TES") observed that TES, as Program Manager, had not yet accepted the EOI and that its contents were therefore subject to revision. l l l

The insistence of the DCP that the IDVP " clear" its preliminary conclusions with the Project prior to issuance of an EOI is wholly improper. This suggestion is reminiscent of PGandE's editorial review of i the Cloud Report which gave rise to our concerns about RLCA's independence almost eighteen months ago. The purpose of an EOI is to document discrepancies for subsequent resolution. Once i an EDI is issued, the DCP has every opportunity to respond and, l if possible, to justify the existence of the discrepancy. On the other hand, if these issues are resolved behind closed j doors, in private off-the-record discussions with the IDVP, i neither the NRC, the parties to the Diablo Canyon proceeding, l nor the public generally will be informed about or have an opportunity to evaluate the concerns or the appropriateness of i the resolution. Indeed, the very reason for an independent audit -- to ensure that the errors and discrepancies which had remained hidden from public view in the past will be fully disclosed and corrected -- would be frustrated if the DCP's suggested " pre-screening" procedure were adopted. t l The improper and undesirable effect of such a proposal is j well illustrated by the specific context in which the June 14th j discussions arose -- EOI 1132. The position of the DCP -- that i j prict discussions could have obviated the need for an EDI or 1 resulted in an EOI~that merely noted the necessity for l j qualification of slabs -- is indicative of a fundamental i misunderstanding of not only the specific EOI, but the basic j purpose of the IDVP. The significance of this item was not simply (1) that the slabs had not been properly qualified, but ) (2) that the DCP Schedule erroneously indicated building member evaluations were complete, and (3) that the Final Report was sufficiently ambiaucus to reinforce the erroneous statement in the Schedule. Each of these matters warrants concern and, l thus, should be documented through an EOI. i The DCP personnel repeatedly stated that an EDI was unnecessary because the discrepancy was simply the result of poor communication between the DCP and the IDVP. Even assuming j that to be true, this EOI is significant because it raises the J generic concern of whether additional representations of i completed work may also have been made by the DCP where the ] work is not in fact complete. J.* Harold Denton Director of Nuclear Reactor Regulation June 23, 1983 Page 4 L' such representations is particularly significant in light of the importance that the DCP has attached to its three-step licensing schedule in order to obtain reissuance of the low power license at the earliest possible date, notwithstanding the fact that numerous safety-related modifications and critical reports remain incomplete. The DCP would obviously prefer that the concern underlying EOI 1132 never be revealed to the NRC, the parties, or the public. Its preference, however, is inconsistent with the basic principle of independence so critical to the IDVP. The kind of pressure exerted on the IDVP by the DCP personnel at the June 14 meeting.-- pressure sufficiently great to cause the IDVP to reconsider the language in EOI 1132 -- will undermine the progress of the audit and public confidence in the integrity of the its findings. We trust-that adequate steps will be taken to address the concerns discussed above, including procedural safeguards to ensure that the DCP is not permitted to pre-screen EOIs or, through' improper pressure, to cause the nondisclosure of information and/or safety concerns discovered by the IDVP. Hubbard of this office on June 21, 1983, of your facility at Large, Pennsylvania, and to the discussions of our findings with Mr. N. R. Pfeifer. This inspection consisted of witnessing the seismic testing of a Hagan Manual / Auto Station for the Diablo Canyon Unit 1 Nuclear Power Station. Specific areas examined during the inspection and our findings are discussed in the enclosed report. Within these areas, the inspection consisted of an examination of proced'ures and representative records, interviews with personnel, and observations by the inspector. Within the scope of this inspection, we found no instance where you failed to meet NRC requirements. In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter and the enclosed inspection report will be placed in the NRC's Public Document Room. If this report contains any information that you believe to be exempt from disclosure under 10 CFR 9.5(a)(4), it is necessary that you (a) notify this office by telephone within 10 days from the date of this letter of your intention to file a request for withholding; and (b) submit within 25 days from the date of this letter a written application to this office to withhold such information. Test Program: The purpose of the testing was to seismically qualify a Hagan Manual / Auto (MA) Station to the most recent seismic requirements for Diablo Canyon Unit 1 nuclear power station. The seismic testing was performed in accordance with approved procedures " Seismic Qualification Test Plan of M/A Station for Diablo Canyon Project, Part I," STP (Seismic Test Plan)-069, dated June 1983. Functional testing of the M/A station during the seismic tests was performed in accordance with the requirements of " Seismic Qualification Test Plan for Diablo Canyon," STP-069, Part II, dated June 1983. Westinghouse Nuclear Technology Division (W-NTD) had overall responsibility for the test effort. Westinghouse Nuclear Systems Instrumentation Division (W-NSID) was responsible for functional testing of the M/A station during the testing. W-AESD's responsibilities were for the actual performance of the seismic test and data recording. 2. Test Item: The test specimen was a Hagan M/A station which was specially modified for Fischer control loops. The M/A station was identified as model number 124, tag number HC-86, item 149, board section 2VB3, serial number 145, assembly 4111081-601. The test specimen was installed in a test fixture which simulated the vibrational characteristics of the main ' control panel at Diablo Canyon.

Test Setup: Testing was performed on W-AESD's magnesium (MAG)- shaker table. This table provides a simulated three dimensional environment for test specimens. Table driving force is provided by a single hydraulic cylinder at an actuation angle of 35 26' from the horizontal axis of the table surface. The test fixture was attached to the table at a 45 degree angle to the horizontal component of the table driving force. This test setup provided equal input forces to the test fixture for all three (X, Y, and Z) axes of vibration. 4. Test Results: M/A station seismic testing was conducted on June 21, 1983, and consisted of one sine sweep test with the sweep going from 1 hertz (HZ) to 50 HZ and back to 1 HZ. Following the sine sweep tests, five operating basis earthquate (0BE) tests were performed using a "multifrequency multi-axial" sine beat input tape provided by W-NTD. Frequency ranges of the input tape were 1 HZ to 32.95 HZ. After the OBE tests were performed, four safe shutdcwn earthquake (SSE) tests were perf w ed using the same type of input tape, but at higher "G" levels than the OBE tests. Between each of the SSE tests, the test fixture, including the test specimen, were rotated 90 degrees clockwise (looking down on the table) from the previous test position. One deviation from the approved test plans was coserved during inspection of the test setup. This deviation had to do with the location 'of input and response accelerometers. Their locations for the testing were not in accordance with the approved test plans; however, proper approval of the locations used during testing were obtained and the deviation was properly documented. 5. Inspection Results: The NRC inspection was accomplished by discussions w;tn personnel from W-AESD, W-NTD, W-NSID, anc Pacific Gas and Electric Company; review of test plans, data ano documentation; and witnessing of test operations. The results of this inspection are as follows:

O-The fiRC staff has reviewed the Westinghouse Owners Group (WOG) generic - design modification to provide. automatic reactor trip system actuation of-the breaker shunt trip attachments. The details of this modification were provided to the liRC by letter dated June 14, 1983, from J. J. She? pard (WOG Chairman) to D. G. Eisenhut (Director, DL). The staff considers autocatic actuation of the reactor trip breaker shunt coil trip attachment to be a safety related function. Therefore, the circuitry used to implement this function must be Class IE. Our review consisted of an evaluation of the WOG design modification for confomance to the criteria of IEEE Standard 279-1971 " Criteria for Protection Systems for fluclear Power Generating Stations." Based on our review, we conclude that the generic design is acceptable and our Safety Evaluation Report on .the proposed generic design is enclosed. Although the proposed generic design is applicable to most Westinghouse plants, specific design information will be required for each individual plaat incorporating the automatic shunt ' trip modification. The required plant-specific infomation is identified in the enclosed Safety Evaluation and sumari::ed in the attachment to our safety evaluation. Per our discussioqs-with you and your recommendation, copies will be trans-mitted by you to all Westinghouse owners for their use when responding to Generic Letter 83-28 " Required Actions Sased on Generic Implications of.
