DEFERMENT OF EXERCISE OF ENFORCEMENT DISCRETION On September 11,1998, in EN 98-060, the staff advised thc Commission that it intended to exercise enforcement discretion pursuant to Section Vll.B.6 of the Enfoteement Policy and not issue a Notice of Violation or propose a civil penalty for a Severity Level i I I problem involving a nonconservative assumption in the Safety Analysis Report (SAR) updated accident analysis. That decision was based on, among other reasons, the certificate holder's corrective action to resolve seismic weaknesses, as detailed in a Confirmatory Order that required action to be completed by September 30,1998. Tha staff has decided to defer issuing the action until it has had an opportunity to verify the corrective action in l accordance with the Confirmatory Order A new EN will be issued prior to issuance of the action. l 1
