Bethesda, Maryland Docket No. 70-7001 SLubjegi: ISSUANCE OF EXERCISE OF ENFORCEMENT DISCRETION On September 11,1998, in EN 98-060, the staff advised the Commission that it intended to exercise enforcement discretion pursuant to Section Vll.B.6 of the Enforcement Policy and not issue a Notice of Violation or propose a civil penalty for a Severity Level lil problem involving a nonconservative assumption in the Safety Analysis Report (SAR) updated ,
accident analysis. 'laat decision was based on, among other reasons, the certificate holder's corrective action to resolve seismic weaknesses, as detailed in a Confirmatory Order that required action to be completed by September 30,1998.
On September 23,1998, in EN 98-060A, the staff advised the Commission that it intended to defer issuing the action until it had had an opportunity to verify the corrective actions in accordance with the Confirmatory Order. In addition, this EN stated that a new EN would be issued prior to issuance of the action.
The staff verified that the Certificate holder completed the required actions described in the Confirmatory Order. The Office of Enforcement (OE) just became aware that the letter exercising enforcement discretion was issued on October 9,1998; and OE was therefore unable to provide the Commission notification. The staff will be preparing a lessons-learned on this matter.
