REQUEST FOR OFFICE COMMENTS AND CONCURRENCE PROPOSED RULE l ENTITLED " NUCLEAR REGULATORY COMMISSION ACQUISITION REGULATION !
(NRCAR)" i Reference your August 14, 1997, memorandum, subject above, please be advised that the Office of Investigations (01) has reviewed this document and provides :
the following observations: ;
4 As you may recall. 01, on occasion based upon a request by the Department of l Justice (D0J), has sought authorization to utilize retired 0I agents to pursue l OI investigative matters. Although infrequent (twice in the last five years), '
their proposed utilization was critical to the 01 mission. In both instances, the retired employees in question had handled the case while with 01. Since i the matter had been subsequently referred to 00J their 0I experience and j knowledge of the case was essential for the successful completion of D0J's l efforts. l Upon reviewing the suggested revisions to NRCAR and after contact with l officials within the Office of the General Counsel. OI has been advised that l the sections in question regarding the employment of former OI agents has not ;
been substantially changed. In short. it is our understanding that the exceptions that were allowed previously have not been altered under the new revision.
In light of the above. 01 concurs in the above referenced proposed rule.
