01 REPORT 2-96-036; RE: BRUNSWICK STEAM ELECTRIC PLANT -
DISCRIMINATION AGAINST ENGINEER FOR RAISING TECHNICAL CONCERNS ABOUT EQUIPMENT QUALIFICATION PRACTICES The above captioned 01 report involves the investigation of an engineer, employed by Carolina Power and Light Company at the Brunswick Steam Electric Plant, who alleged that he had received an adverse performance appraisal and had been subjected to a hostile working environment because he had identified equipment qualification deficiencies to his management.
01 did not substantiate the allegation. Therefore, it appears that enforcement action is not appropriate at this time.
It should be noted that the September 4, 1996 Department of Labor (DOL) Assistant District Director's finding did not substantiate the discrimination.
The alleger has appealed the finding to the 00L Chief Administrative Law Judge to request a formal hearing.
I do not intend to request an 0GC analysis of this report.
We will monitor the proceedings and reserve our opportunity to revisit this issue.
Region II should provide a copy of the 01 report without the exhibits to the parties in the D0L proceeding. We will continue monitoring the DOL proceeding unless we receive a different view within three weeks of the date of this memorandum.
