01 REPORT 2-97-015; RE: BRUNSWICK: ALLEGED DISCRIMINATION AGAINST AN EMPLOYEE FOR RAISING CONCERNS REGARDING THE ENVIRONMENTAL QUALIFICATION PROGRAM TO THE NRC The above captioned Ol report involves alleged discrimination against an employee for raising concerns regarding the environmental qualification (EQ) program at Brunswick to the NRC, Specifically, the employee alleged that he was not considered for a newly created management t

position within the licensee's EQ program becauss he identified deficiencies in the Brunswick EQ program to the NRC. 01 did not substantiate the allegation that the licensee discriminated against the employee for raising concerns. Therefore, it appears that enforcement action for discrimination is not appropriate in this case.

i Since 01 did not substantiate the allegation that the licensee discriminated against the employee for raising concerns, OE does not intend to request an OGC. analysis of this report. OE will consider the matter closed unless OE receive a different view within three weeks of the date of this memorandum. OE understands that the regional staff is proceeding with non-escalated enforcement action for technical issues related to this investigation and the employee's complaint.
