NOTICE OF VIOLATION AND PROPOSED IMPOSITION OF CIVIL PENALTY (NRC INSPECTION REPORT NO. 50-344/86-06)

This refers to an inspection conducted by the NRC during the period of January 28-30 and February 24-28, 1986, of activities authorized by NRC License NPF-1 for the Trojan Nuclear Plant. Based on the results of this inspection, it appears that certain of your licensed activities were not conducted in full compliance with NRC requirements. A copy of the Inspection Report (50-344/86-06) was sent to you by letter dated March 21, 1986. An enforcement conference to discuss these matters was held on March 27, 1986, with members of your staff.

The violation in the enclosed Notice of Violation and Proposed Imposition of Civil Penalty involves your failure to maintain the control room emergency ventilation systems in an operable status over an extended period of time.

The system was inoperable because inleakage pathways existed and flow rates were excessive. In addition, system independence was compromised in that a common drain line connected both trains of the control room emergency ventila-tion systems. Although this system was not called upon to operate, if its operation had been necessary during an emergency situation, it is estimated ,

that control room personnel could have been subjected to radiation doses in excess of those permitted by 10 CFR Part 50, Appendix A, Criterion 19.

Deficiencies in design, construction, and preoperational testing contributed to the inoperability of the system. .

The violation and its duration, which may have been since initial plant operation, reveals weaknesses in: (1) the conduct and documentation of technical work at Trojan; (2) the knowledge and understanding of your operations and engineering personnel regarding the actual plant configuration; and (3) the thoroughness of audits conducted by quality assurance personnel. Portland General Electric Company MAY 141986 in the surveillance testing procedures for the control room emergency ventilation tAtem, the most significant of which involved the positioning of, makeup air dampers and determination of the proper makeup flow rate. We note that this violation is the latest in a series of problems which has included escalated enforcement that have occurred over the past few years indicating a need for you to review and implement more effective controls to ensure NRC requirements are satisfied.

To emphasize the importance of appropriately operating, inspecting, testing and maintaining all safety-related systems in an operable condition, I have been authorized, after consultation with the Director, Office of Inspection and Enforcement, to issue the enclosed Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Eighty Thousand Dollars ($80,000) for the violation set forth in the enclosed Notice. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985) (Enforcement Policy), the violation described in the enclosed Notice has been categorized as a Severity Level II. The base value of a civil penalty for a Severity Level II violation is $80,000. The escalation and mitigation factors in the Enforcement Policy were considered and no adjustment has been deemed appropriate.

You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. In your response, you should document the specific actions taken and any additional actions you plan to prevent recurrence. In addition to your response to the enclosed Notice, particular emphasis should be given to the concerns which are revealed by the violation and discussed above. After reviewing your response to this Notice, including your proposed corrective actions, the NRC will determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and its enclosure will be placed in the NRC Public Document Room.

The responses directed by this letter and the enclosed Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act ef 1980, PL 96-511.
