AUGUST 4, 1987 MEETING WITH STATES ON TOPICAL REPORTS On August 4,1987, Mr. Terry Strong, Washington Department of Ilealth and Social Services and Mr. Virgil Autry, South Carolina Department of Health and Environmental Control attended the Comission briefing on low-level waste. At the complation of the Comission meeting, the State representatives met with NRC staff to discuss some NRC staff concerns over polyethylene high integrity containers, cement solidification process, bitumen waste fom and other items of concerns regarding topical reports. The attendees were as follows:

- 1. The NRC has several topical reports (over 15) which it has not completely reviewed. These topical reports were submitted in 1983
. efter the pronvigation of 10 CFR Part 61 when the fee for the review of topical report was waived by NRC. Through agreement with the States of Washington and South Carolina, the processes submitted for topical review, such as cement, would be acceptable for use at .
the two comercial facilities regulated by these States until such time as NRC completes the evaluation. This agreement only applies to those processes which have been submitted as a complete topical q ,

rep **t for NRC's evaluation. Highintegritycontainers(HIC)were not incluued in this agreernent. However, the State of South Carolina had previously evaluated and issued certificates of conpliance for several polyethylene high integrity containers for use at the Barnwell site. These products are still in use now.
One topical report on ferralium HIC has been approved for use at Richland under certain conditions.
- 2. The NRC has contracted with Brookhaven National Laboratory to assist in the evaluation of sone of these reports by conducting analyses pertaining to stability. Two if the Brookhaven reports were discussed during this meeting. It sas noted that there are problems with polyethylene HICs and cement solidification processes.
In view of these problens noted from Brookhaven's investigations, the NRC felt it was necessary to discuss these problems with the States in view of their present use at the sites. Since this neeting was a preliminary overview of the technical concerns, these problems will be more fully discussed in the August 13 telecon.
- 3. South Carolina was interested in knowing if any of the data indicated that there was a significant problem with respect to material already buried. The State is concerned over backfitting. The NRC staff acknowledged the State's concern and will address it.
4 One of the problems bought to light by the Brookhaven studies was the necessity to strength the language of the branch technical report / draft reg, guide on waste fom which the topical reports were submitted under to elevate any future concerns over material that ray have been previously approved using these documents but have not met stability requirements for disposal. Thus, strength-ening these reports would curtail any future concerns over whether or not material buried in containers which met the BTP would need any backfitting.
In sumary, the NRC intends to address the backlog of topical reports considering the additional infomation brought to light by the Brookhaven studies. NRC is aware that presently the licenses art Barnwell and Hanford require that solidification processes meet NRC's branch technical position on waste fom for acceptance at the burial site. These issues will be discussed in more detail on August 13, 1987.
