Dear Mr. Daniels:

By letter dated May 20, 2020 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20157A123), NorthStar Nuclear Decommissioning Co., LLC requested U.S. Nuclear Regulatory Commission (NRC) approval of alternate waste disposal. The request was made in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Section 20.2002, "Method for obtaining approval of proposed disposal procedures."

Specifically, NDC requested approval to dispose of approximately 2,000,000 gallons of low-activity radioactive wastewater containing byproduct material, from activities associated with the decommissioning process at Vermont Yankee Nuclear Power Station, at the US Ecology, Inc (USEI) Resource Conservation and Recovery Act, Subtitle C hazardous waste disposal facility located near Grand View, Idaho.

Since the USEI facility is not an NRC-licensed disposal facility, USEI submitted, under separate letter (ADAMS Accession No. ML20174A590), a request for an exemption pursuant to 10 CFR 30.11 to allow for the disposal of the byproduct material at the USEI facility.

The purpose of this e-mail is to provide the results of the NRC staffs initial administrative and acceptance review of the submittals. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the applications have any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant. The NRC has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the NRC to complete its detailed technical review and make an independent assessment regarding the acceptability of this request in terms of regulatory requirements and the protection of public health and safety and the environment.

Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRCs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed to address these areas, you will be advised by separate correspondence.
