SUBJECT:

MEMORANDUM OF ADMONITION On June 29, 1983, you delivered a memorandum of admonition to me regarding the Applegate FOIA matter and, at the same time, told me that the memorandum was supported by yourself and Comissioners Ahearne and Robertsi and opposed by Comissioners Gilinsky and Asselstine who favored stronger actions.

I subsequently requested that the Comission raconsider this memorandum and late in the afternoon of June 29 the Comission did meet for the specific purpose of reconsideration. After this meeting you called me to your office and, reading from your notes of the just concluded Comission meeting, told me that upon reconsideration 5 Comissioners Ahearne and Roberts had withdrawn their support for the memorandum; you felt that the memorandum was appropriate; and Comissioners Gilinsky and Asselstine favored stronger action, You advised me that the net effect of the June 29 meeting was that, upon reconsideration, the Comission was split 2-1-2, that is, two in favor of no disciplinary action.

Finally you advised me that in view of the above, the June 29 action was.now without majority support and a memorandum would be sent to me from the Comission which would in effect retract the June 29 memorandum of admonition.

The following day, June 30, you called me in the morning to say that Comissioner Gilinsky had objected strongly to your version of the outcome of the June 29 meeting and that another Comission meeting kould be held on June 30. As a result of the June 30 meeting you have now advised me that, contrary to what you had told me on June 29, the Comission has decided not to t

l send me a memorandum retracting the June 29 memorandum of admonition and further that at the June 29 meeting Comissioners Gilinsky and Asselstine had supported the memorandum of admonition.

This contradictory situation not only disturbs me greatly but, coupled with' past posturing and maneuvering on this same matter forces me to be suspect of the motivation behind this whole proceeding.

Because of this I request that I be provided with copies of the tapes and transcripts of all Comi" 'on meetings wherein this subject was discussed in any way along with dher documentatidh in the form of any notes, drafts, memoranda, and so forth that have been prepared on this subject by individual Comissioners, their staffs or members of the Office of the Taeneral Counsel, cc: Comissioner Gilinsky Comissioner Roberts Comissioner Asselstine l
