AFFIDAVIT

I, James J. Cummings, do hereby depose and say as follows:

1.

On September 22, 1983, I was orally notified by Chairman Palladino of the Commission's decision to remove me from my present position as Director, office of Inspector 1

and Auditor (OIA), and to reassign me to another Senior Executis t l

Service (SEs) position, to be determined at a lateir date.

I the evening of September 28, 1983.

Implementation of this l

decision was taken by the Cotanission on September 30, 1983, by I

j virtue of a memorandum to me from Chairman Palladino which de-i l

tailed me to the staff of the Executive Director for operations l

4 (EDO) effective October 1, 1983.

To date, I have received no written notification of j

the impending Commission action nor have I received a written I

explanation of the reason for the detail.,

On September 22, 1983, Chairman Palladino met with I

I asked Chairman Palladino for the vote of each Com-missioner in this matter and he told me that the Commission had j

i not agreed on revealing how individual Commissioners had voted 4

l or what the actual vote was.

had voted against the action.

When I asked Chairman Palladino for the specifics as to the reason (s) why the Commission had lost confidence in me he replied that although a gr' eat deal of discussio had taken place he had not been able to pin individual Commissioner down and he was therefore unable to articulate the specific reasons attributable to each Commissioner.

He suggested that I ask each Commissioner directly.

Since Chairman Palladino had attended all of these Commission meetings I asked him for his opinion or impression of the reasons why the Commissioners had lost confidence in me.

In response, Chairman Palladino noted he could recall three topics which were discussed at the meetings.

These were (1) the Hoyt/Alcot reports (2) my July 15, 198.3, memo to the Commission i

regarding the Applegate FOIA matter, and (3) my August 26,,1983, r==__.

memo to the Commission regarding Travel'in L932,_

At the close of my meeting with Chairman Palladino I told him that I was shocked by the Commission's action, particularly with regard to the cavalier manner in which the Commission had acted and more particularly because the rubric of "loss of confidance" i

was totally without spe c i'f ic ity.

Later that same day I asked to meet with the Commission on September 33, 1983.

Following my meeting with Chairman Palladino, I requested a meeting with Commissioner Roberts.

Commissioner Roberts, who normally made himself readily accessible, refused to see me and I therefore surmi ed at that time that he had voted for my removal / reassignment.

That evening I called Commissioner Roberts at his I

I home.

I prefaced my conversation with Commis'sioner Roberts by telling him of my morning meeting with Chairman Palladino.

Commissioner Roberts confirmed that he had voted for my transfer and although reluctant to speak to me about the Commission's actions did tell me that he had voted for my removal / reassignment because (1) although he had usually sup-ported me on most issues he was sick and tired of spending so j

much of his time and the Commission's time debating the pro's and con's of my stewardship of CIA with Commissioners who had long sought my ouster, (2) he considered my August 26, 1983, t

memorandum as being overly aggressive and a clear attack on

the Deputy General Counsel, and (3) although he did not seek i

to be Chairman'of the NRC hs considered Chairman Palladino to be a very weak and ineffective Chairman and Commissioner Roberts wanted to see Palladino out of the Chairmanship so that the ws,rk _

of the Commission could go forward and my removal / reassignment would assist in this regard by creating adverse publicity for Chairman Palladino.

Commissioner Roberts terminated our conversa-l tion by telling me I was a political casualty.

8 The following day, September 23, 1983, I met with the full Commission at a closed meeting.

At this meeting I told the Commission, among other things, of my meeting with Chairman Palladino on September 22, 1983, and of my shock,

I. told the Commission that not having afforded me the opportunity to be aware of their concerns coupled with no opportunity to rectify or mutually resolve any shortcomings on my part seemed to me to be rather unfair.

Sinew Commissioners Gilinsky, Asselstine and Roberts had voted for my reassignment I asked them to provide me with specific reason (s) which caused then to lose confidence in my ability to perform the duties of my position.

Commissioners Gilinsky and Asceltine refused to answer the question while Commissioner Roberts replied that he would not say that I had not performed my job in a satisf actory manner.

To date I have received no further explanation from the' Commission as to the reason (s) for my removal reassignment.

Under penalty of perjury, I declare that the foregoing is true and correct.
