INCLUSION OF ADDITIONAL DOCUMENTS I IN FOIA-84-61 (CUMMINGS REQUEST) l James Cummings has requested that selected material released I to him in connection with FOIA-84-61 be placed in the Public j Document Room file applicable to his request. When -

originally released to Mr. Cummings, several documents were not placed in the PDR FOIA file because they contained personal privacy information related to Mr. Cummings. In requesting that the material be placed in the PDR, Mr. Cummings has effectively waived his protections under exemptions 2 and 6 of the FOIA. A copy of the documents to be placca in the PDR file retrievable with reference to FOIA-84-61 is attached.

The attached letters from the Department of Justice's (D0J) General Litigation Section, stem from their frustrations in trying to deal with the NRC while DOJ is considering the possible criminal aspects of the fluelear Phamacy, Inc. (NPI) c'ase. In my opinion letters similar to the ones attached - but milder - were draf ted some months ago by D0J but were not sent based on my assurances that NRC would keep 00J infomed of any future actions they plan to take relative to the liPI case. The Office of Inspection and Enforcement (IE) meeting with flPI on January 21, 1980,'was evidently the straw that broke the camel's back.

To be perfectly frank, I do not disagree with the overall thrust of the ,

D0J 1etters. '" '. office has repeatedly experienced the same frustrations in tryino to c. dith IE and ELD in the liPI case and other cases involving -

potential criminu.ity. Prcept notification, coordination and cooperation by IE with M with regard to potential criminal matters is for all =,

practical I.urposes non-existent. Over the past several months I have personally met with senior IE ' staff officials.on this subject - no substantial oroaress has been made. This ,is not a trivial matter.

Dich DeYoung and I will meet oh Friday March 12 to discuss this t.atter further. I am confident that we can resolve this issue and I wil" keep you infomed of the status of )he' discussions. ~ ,
