subject to the resolution of items we have brought to the attention to Chairman Zech. (see enclosure).

Essentially, we believe it is in the Commonwealth's best interests and in keeping with the purposes of the au2nented teats inspec t ;on to perini t the Consonwealth to have rote than l one observer or participent. Dear Mr. Barry:

I have received your letter of July 8, 1988 regarding the Comonwealth of Massachusetts' request to participate as an observer in the Integrated Assess-rent. Teas Inspection (IATI).

My understanding of your July 8,1938 letter indicates thtt the Commonwealth of Mas,achusetts agrees to abide by the "Guidelines for Accompaniment on the Integrated Assessment Teani Inspection", subject to the resolutica of items brought to the attention of Chatroan Zech by a letter dated July 7,1988. In that the issues contained in the letter of July 7,1988 go beyond the estab-lished Region I protocol, we are not prepared at this time to address these issues pending review and response by the Chairman. In the interim, our stand-ard protocol, utilized by other states to provide for inspection involvement, and forwarded to you on June 1,1988 remains available. I believe our standard protocol conforms with NRC's proposed policy regarding Cooperation with States at Cometrical Nuclear Power Plants and Other Production and Utilization Fact-litias, published in the Federal Register on June 13, 1988, (see 53FR21961).

h will be necessary for the appropriate state representative to agree to the guidelines and have the designated representative acknowledge by his signature that he will follow the protocol.

I would like te clarify two points rade in both your July 8,1988 letter to me and in the July 7, 1988 letter to Comissioner 2ech. First, the designated individual will accompany the NRC inspector (s) and will be given access to all aspects of the team inspection, including team reetings and entrance and exit reetings with the licensee. The representative is espected to rate observa-tiens relative to the licensee and work within the inspection team concept to have his/her issues addressed. Second, with respect to the number of state observers, as has bean the case in a number of past state accompaniments, we espect the Co'nncnwealth representative to collect and coordinate the concerns from the various interests within the Cor.Tonwealth, be they f rom the local governrents or from the State's Attorney General's Of fice. In short, we place the burden on the the Comonwealth's representative to represent the many views f rom within the Coreenwealth. Those views and issues should be made known and will be considered for inspection reytiv during develo*%t of the inspection l scope. This precludes the need to have nultiple repri sintatiives f rom each of those state groups. This protocol has proven ef fectivt in setting the mutur.1 needs of the states of New Jersey, New York, Pennsylvanis and Vermont in past applications, l

if you feel the need to better understand the basis for the estabitshed proto-col, I would propose that a meeting be held in Region I with the appropriate Comonwealth of Massachusetts representative avaliable to address these issues.

This reeting will be a noticed public meeting and should be held at a schedule consistent with your previous request to participate in the IAT1.
