October 8, 1987 Meeting with Commonwealth of Massachusetts Regarding the Pilgrim Nuclear Power Station On October 8,1987 a meeting was held at the Region I office, King of Prussia, Pennsylvania with five Massachusetts officials to discuss the Commonwealth's concerns and the status of the NRC staff position on emergency planning, safety enhancements, and management deficiencies regarding the Pilgrim Nuclear Power Station.

The meeting was requested by Massachusetts's Assistant Secretary of Public Safety. is a copy of the meeting agenda incorporating the topics requested by the Commonwealth representatives. is the list of meeting attendees.

The following is a sumary of the significant items discussed.

At the start, Jay Gutierrez, Regional Counsel, explained that although the NRC was prepared during the meeting to discuss the status of the issues of concern to the Commonwealth, the staff was not prepared in the meeting to discuss how each issue would be resolved or how it would factor into the staff's final dec3 ion on the 2.206 petition currently under review.

With this understand-ing, the discussion was opened by John Judge, representing the Governor's of fice, who stated the Commonwealth's position regarding Pilgrim Restart.

In summary, the Commonwealth requested that the NRC conduct full adjudicatory hearings on the Pilgrim restart issues related to management deficiencies, reactor safety issues, and emergency e,*cuation planning; and that Boston Edison be prohibited from taking any actions towards restart, including refueling.

(Note: On October 15, 1987, Governor Oukaki-s and Attorney General Shannon filed a 2.206 petition with the NRC requesting a full adjudicatory hearing to address and resolve the plant'<. management, plant design and J

emergency planning deficiencies.

The petition also requested an imediate order precluding Boston Edison from taking actions in its power ascension program until a hearing is held.) Representative Lawrence Alexander added that the State and local emergency plans should be approved by the Governor and local Selectmen; and that a full scale exercise should be held to evaluate 'the emergency plans prior to restart.

When asked about the status of the offsite plans, Peter Agnes stated Massachusetts is working in good faith with Boston Edison to gather information, but that they have not made a determination if adequate olans can be developed for the Pilgrim facility.

A copy of the re-suits of emergency planning activities will be provided when a available.

In response to the Commonwealth's statements of concern, William Russell, Regional Administrator acknowledged the Comonwealth's ef forts in emergency planning and participAti'on in the restart process.

decision to restart Pilgrim would be made by the Commission after significant review by Region I, Headquarters and the Commission.

Russell reiterated NRC's position that the FEMA Emergency Planning deficiencies would be addressed along with the other Pilgrim issues prior to restart.

Also, the st.aff will conduct meetings in the vicinity of the Pilgrim Station to hear public comments on the Boston Edison Company's restart plan.

With regard to NRC staff position on specific issues requested by the Massachusetts officials, the following information was provided; Security Violations Currently in the NRC enforcement process, and therefore cannot discuss predecisional information.

BECo Proposal to Postpone Biannual Exercise BEco request for deferral of full scale exercise is under NRC staff review.

Limited scale exercise is scheduled for December 9, 1987.

NRC Position on H.R.1570 (The Nuclear Power Response System Act)

Statement presented by Chairman Zech on H.R.1570 on October 1,1987 provided to Massachusetts officials.

BEco Safety Enhancement Proqram/NRC Review Described Licensee 50.59 Review, NRC Safety Evaluations and No Significant Hazards Determination.

Allegations Described how allegations are processed by NRC.-

With regard to the excessive overtime allegations, the licensee will provide a report to the NRC.

Documents supplementing the discussion of these topics were transmitted to the Massachusetts State Liaison Officer on November 9,1987 (Enclosure 3).
