STATUS OF THE B&W-GPU LAWSUIT DOCUMENT REVIEW Item VI of the Secretary's April 8,1983 memorandum concerned the staff's review of documents related to the B&W-GPU lawsuit. The staff is in the process of acquiring the additional documents discussed by Mr. Robert Arnold during the April 6,1983 Commission meeting. The major portion of these documents is expected to be available for review the week of April 18, 1983.

Further effort will be required of GPU to insure that all documents sought by the staff are provided. We are as yet unable to determine when this effort will be complete.

The documents to be provided include depositions and exhibits. The exhibits used during the lawsuit can be categorized as follows: 1) exhibits used during the trial, 2) exhibits used during the 81 depositions taken by B&W-GPU in preparation for the trial and 3) potential exhibits not used during the trial.

The staff review, which was completed March 28, 1983, examined the exhibits which were used during the trial. The other two categories have not been previously reviewed by the staff.

The discovery phase of the lawsuit resulted in approximately 1,512,000 pages or 710 linear feet of material (using the thumb rule of 177 pages per inch).

The staff's recently completed review lasted 3 months and examined approxi-mately 15 linear feet of material. The additional documents to be provided by GPU constitute approximately 60 additional-feet. Thus, the review described in the Secretary's April 8,1983 memorandum could take approxi-mately four times the effort expended in the earlier staff review.

The staff is developing a plan to sort this information and review selected documents. Upon receipt of the additional documents, the staff will be able 8305040054 830420 PDR ADOCK 05000289 Q PDR

2-to finalize this plan and determine the amount of effort necessary to complete this partial review. The staff expects to be able to apprise .the Commission of this matter in approximately 2 weeks.
