ALLEGATION RE: TOOL ISSUANCE AT FERMI (50-341)

(AMS N0. RIII-87-A-0172)

Reference March 23, 1988, memorandum, same subject.

The reference memorandum stated that the employment discrimination matter before the U. S. Department of Labor Wage and Hour Division was decided in favor of the alleger and Detroit Edison was ordered to reinstate the alleger to his former position. The memorandum further recommended that Division of Reactor Projects begin review of this matter for possible enforcement by NRC, as well as issue a letter to Detroit Edison to respond to the possible "chilling effect" aspects of this matter.

The Division of Reactor Projects has learned that Detroit Edison has requested a hearing with the U. S. Department of Labor in this matter. Therefore, the action that you recomended will be held in abeyance pending the results of the aforementioned appeal by Detroit Edison. The status of AMS No.

RIII-87-A-0172 should be revised to reflect the above information.
