Subject: NOTICE OF VIOLATION (Inspection No. 50-219/87-37)
This letter refers to the special safeguards inspection conducte.d by
Mr. G. C. Smith of this office on October 23, 1987, at the Oysur Creek
'
Nuclear Generating Station, Forked River, New Jersey, to rey!n the circum-
stances associated with an apparent violation of the NRC-approled physical
security plan at Oyster Creek, which was identified by your security force
and reported to the NRC. The apparent violation involved a degradation of
a vital area (VA) barrier. A copy of our inspection report is enclosed.
The violation, which is described in the enclosed Notice, involved the removal,
during preparation for maintenance, of a VA access plate, which caused the
degradation of a vital area barrier in that two of the three security access
control elements were inadequate, namely, the barrier and monitoring elements.
Although violations involving the loss of two access control elements would
normally be classified at Severity Level III in accordance with the "General
Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR 2,
Appendix C (Enforcement Policy) (1987), the violation has been classified at
Severity Level IV based on its low safeguards significance in that although the
degraded barrier allowed access to the VA, it was entirely contained within
another VA to which access was controlled and, therefore, only individuals
authorized access to the surrounding VA could have gained access to the inner
VA.

Nonetheless, the NRC is concerned that maintenance personnel degraded a VA
barrier without first notifying the security department. As a result, appro-
priate compensatory measures were not taken. Further, when this condition
.
was identified by a member of the security force, although a guard was posted
!
at the area as a compensatory measure, additional actions were not taken to
stiarch the area. This violation demonstrates the importance of appropriate
coordination between plant personnel and the security department when mainte-
nance and other plant activities are to be performed. Therefore, we emphasize
that any similcr violations in the future may result in escalated enforcement
action,

You are required to respond to this letter and the enclosed Notice, and in
preparing your response, you should follow the instructions specified in the
enclosed Notice.
In your responsa, you should document the specific actions
taken and any additional actions you plan to prevent recurrence.
Further,

you should place all Safeguards Information (as defined in 10 CFR 73.21) in
an enclosure, so as to allow your letter, without the Safeguards Information,

to be placed in the Public Document Room. After reviewing your response to
this Notice, including your proposed corrective actions, the NRC will determine
whether further NRC enforcement action is necessary to ensure compliance with
NRC regulatory requirements.

The enclosed Notice and Paragraph 2 of the enclosed inspection report contain
details of your security program that have been determined to be exempt from
public disclosure in accordance with 10 CFR 73.21 (Safeguards Information).
Therefore, those will not be placed in the NRC Public Document Roum and will
receive limited distribution.
This letter and the remaining portions of the
inspection report will be placed in the Public Document Room in accordance

with 2.790(a).

the clearance procedures of the Office of Management and Budget as required by
