Dear Mr. Stewart:

This refers to your June 17, 1985 letter requesting a reconsideration of the fee categories assigned to Materials License SNM-1872.

The fee categories assigned to a license are based on the types of materials and their authorized uses. Although your letters stated that the authoriza-tion for services other than leak testing was requested for use in the event of accident or. emergency conditions only and is not a regular service to your customers, the review effort required to authorize these services is essen-tially the saae as for other service licenses. For this reason, licenses which authorize the use of byproduct material for service to other licensees are subject to the fees specified in fee Category 3N, and the authorized use of special nuclear material for service is subject to the fees specified in x

fee. Category 1K.

You ' mentioned that the plutonium sources are no longer leak tested even though this authorization remains on the license. Please note, however, that fee Category 1K applies not only to the leak testing of the plutonium sources, but also to the Pu-238 sources authorized in Item 6. A. , which are used in the ser-vicing of the sources as authorized by Item 9A.

We apologize for the incorrect information you were given in December 1984 concerning the amount regt;1 red for renewal. However, in order to consistently apply the regulations in 10 CFR 170 and in fairness to other licensees who hold similar licenses and pay the specified fees, we find the fee categories currently assigned to License SNM-1872 to be correct. Therefore, the $1,280 fee requested in our June 12, 1985 letter remains due and payable.
