SUBJECT:

ZIMMER OL APPLICATION On August 29, 1984 the Atomic Safety and Licensing Board for the Zimmer OL proceeding issued a Memorandum and Order on the Applicant's Motion to Withdraw Application.

The Applicant, prior to this order, had filed

'certain information with the Board indicating that the fuel had been shipped off-site and modifications had been made to the nuclear steam '

supply system rendering it incapable of using special nuclear material.

The Staff had verified Applicant's response.

j The Board conditioned its authorization to withdraw the application on j

implementation of the site restoration plan, which is to ba verified by the Staff by February 28, 1985.

Once that has been accomplished, the 1

Staff should give consideration to cancellation of the construction i

permit.

1 Irrespective of the Applicant's killingness and Staff consent to withdrawal of the application with prejudice, the Board indicated that such a condition to the authorization to withdraw the application was er.9....d, ly i
