COMMENTS ON TERMINATION OF THE ZIMMER PROJECT The EHEB staff was requested to review and comment on the draft NRC action plan for the Zimer closecut. Our comments and suggestions are provided below.

When an applicant decides to withdraw an operating license application or otherwise terminate a partially constructed project, NRC should strive to terminate regulatory oversight in an expeditious and yet orderly manner. NRC's initial authorization to commence construction is granted with the expectation that the project will be completed in an environmentally acceptable manner. It is contingent on commitments made by the applicant and frequently contains specific conditions. Thus, NRC action should accomplish two objectives. First, it should obtain assurance that the site will not be left in a condition which contributes to continued degradation of the environment. Secondly, the CP record (and OL record if available) should be reviewed to identify any commit-ments on the part of the applicant or conditions imposed by the NRC. A determination should then be e f: n to which actions must be implemented prior to abandonment of NRC's interest in the project. A record of NRC staff review should be prepared, which could conveniently take the form of an Environmental Impact Appraisal (EIA).

With regard to Zimmer, the NRC's concerns can probably be met most efficiently by requesting the applicant to submit a formal site dispo-sition plan and schedule; from which the applicant and the staff can establish and subsequently confirm the site restoration steps that should be taken. There is no standard format or spacified content for such a plan, although our procedures at Black Fox and Clinch River provide helpful guidance. I have enclosed a preliminary draft of a Branch guid-ance document we are developing, based on our previous experience, to identify the information we woL ld like to see in order to review a request to terminate a project. This enclosurc is adequate for forward-ing to the applicant in the form of questinnt.

Absent any unusual complications (e.g., ASLB requirements), we believe NRC's concerns can be resolved within an elapsed time period of a few months

. and staff effort on the order of less than one staff month.

Casework schedules'and EHEB workload are such that we would need a 60-day window to complete our review of a site disposition plan, unless adjust-ments were made to existing schedules.

Information flecessary for Environmental Review of Project Termination

1. Provide a site plan showing areas (including transmission corridors) disturbed by construction-related activities. Identify the specific major activity on each disturbed area. Estimate acreage for each such disturbed area.
2. Describe the' status of the entire site,' with particular' attention to disburbed areas and to related erosion and runoff control measures.

Describe impact of cancellation on plans for transmission corridors.

3. Identify or, the site plan all structures. Indicate which structures will be removed and which will remain. Provide a schedule for removal of structures and describe the method of debris disposal.
4. Describe plans for future use of the site to the extent that such plans have tearing on the proposed site restoration work. Indicate
  • the anticipated schedule for future use and describe how the future use influences the proposal for restoration work.
5. Describe proposed restoration activities, procedures, and schedules including grading, seeding, and planting which will be done to leave the site in a stable condition.
6. Identify particularly difficult or costly restoration activities and discuss alternatives.
7. Indicate what permits and approvals will be needed from other federal, state, or local agencies for any of the site restoration work.

Request for Additional Infomation for Environmental Review of Applicant's Request to withdraw the Zimer OL Application By motion dated March 20, 1984 filed with the Zimer Atomic Safety and Licensing Board, Cincinnati Gas and Electric Company (Applicant) requested the issuance of an order authorizing the withdrawal of the application to operate Zimmer as a nuclear plant. The NRC staff's. answer to this motion dated April 9, 1984 advised the Licensing Board that the technical staff is conduct.ing a review of the site to detemine whether any conditions for the protection of the environment are necessary.

in order for the NRC technical staff to complete its review, the enclosed request for additional infomation is needed. We recognize that nuclear plant construction was essentially completed at the time work was terminated and therefore your response to Question 4 may reduce the depth of response to the other questions. In order to firm up the schedule to complete our review, you should provide a date for response to the enclosed request within 7 days of the date of this letter.
