On July 18, 1985, the staff received a telephone request for an extension from Juanita Ellis, President, Citizens Association for Sound Energy (CASE),1426 South Polk, Dallas, Texas, 75224. The staff knows of no reason for urgency in this matter and therefore recomends that the requested extension be granted. Nuclear Regulatory Commission.

ACTION:

Proposed rule: Extension of comment period.

SUMMARY

On May 22, 1985 (50 FR 21072), the Nuclear Regulatory Commission published proposed amendments to its rules of practice to provide special procedures for resolving conflicts concerning the disclosure or nondisclosure of information relating to an NRC investigation or inspection not yet concluded or.which would reveal the identity of a confidential informant and deemed relevant and material to an adjudication. The notice provided a 60-day period for public comment expiring on July 22, 1985. Two interested parties have requested a thirty day extension of time. Based on the significance of the issues involved and other factors, the NRC has decided to extend the comment period to August 23, 1985.

DATE: The extended comment period expires August 23, 1985. Connents received after that date will be considered if it is practical to do so, but assurance

-of consideration cannot be given except as to comments received on or before that date.

UCS requests the additional time in order to develop an alternative proposal that would protect the NRC's interest in conducting confidential investigations of safety problems without violating the public's right to a hearing on issues that are material to licensing decisions.

The developnent of UCS' proposal has been more time-consuming than originally expected, since it involves research into the disclosure requirements of the Freedom of Information Act and the Atomic Energy Act, NRC policy on disclosures, and the experiences of intervenors with NRC investigations of allegations by confidential informants.
