SUBJECT:

REGULATORY HISTORY PROCEDURES In a memorandum dated April 5,1985, the Executive Director for Operations established procedures for ensuring that a complete regulatory history is compiled for each rulemaking action undertaken by an office under his purview (see enclosure). These procedures are applicable to any proposed or final rule submitted to the Federal Register for publication after April 5, 1985. Briefly, these procedures require that --

Documents of central relevance to a rulemaking be maintained and identified for a source of access; and An index of the documents comprising the regulatory history be developed and submitted to the Rules and Procedures Branch (RPB) within sixty days after the rulemaking is completed.

The rule proposing procedures for resolving conflicts on the disclosure or nondisclosure of information related to a not-yet-completed inspection or investigation or revealing the identity of a confidential informant was published May 22, 1985 (50 FR 21072). (I understand from the Office of the Federal Register that their correction to this notice will be published May 31, 1985.) You should forward the index for the regulatory history of this proposed rule to the Rules and Procedures Branch by July 22, 1985.

To assist you in the preparation of the index of the documents centrally relevant to this proposed rule, place the designator "AB78-1" in the upper right hand corner of each such document, including the transmittal memorandum, that you send to the Document Control System (DCS). In addition, each document in the package comprising the Regulatory History that may be released to the public should be marked "PDR." When you are-ready to compile your history, DCS staff will use this designator to retrieve a list of all these documents from their data base that may be useful to you in preparing the index for this proposed rule's regulatory history.
