PROPOSED AMENDMENTS, PART 2, RE: SPECIAL PROCEDURES FOR RESOLVING CONFLICTS CONCERNING THE DISCLOSURE OR NONDISCLOSURE OF INFORMATION This is to confirn information provided telephonically to Jane Mapes of your office by Ronald M. Smith, Office of Inspector and Auditor, on December 4, 1984, concerning the above subject. We concur in the proposed amendments as revised, including not placing a specific employee proscription f6r disclosure of information protected in the proposed procedures. However, based on informal discussion with the Acting Director, Office of Investigations (01) on the same date, we believe it would be prudent to amend 10 CFR 0.735-41 by redesignating)the current language as subsection (a) and by adding a new subsection (b as follows:
(b) No NRC employee, special Government employee, or contract employee, shall knowingly disclose information deemed sealed as ex parte in

camera material under Section 2.7951, Part 2 of this cEapter.
This amendment would clearly provide notice that such infomation should not be disclosed, which is of primary concern to 01.
