DOE ADVISORY PANEL ON WASTE MANAGEMENT ORGANIZATION In response to Section 303 of the Nuclear Waste Policy Act, the Secretary of Energy appointed an advisory panel to study alternative means of financing and managing high-level radioactive waste facilities (the AMFM Panel). The Panel's final meeting on November 13 and 14 concluded in a meeting with Secretary Hodel to discuss their recommendations and forthcoming report. A member of your staff was informed of this meeting on Friday November 9.

A final draft of the Panel's report is expected to be available by mid-December, which we anticipate will be used by DOE as the basis for its report to Congress. Since Section 303 requires the Secretary to consult with the Chairman on the AMFM study, I intend to provide staff comments to the Commission on the Panel's final draft report, and will be requesting your assistance in reviewing this report within the next two weeks.

The current draft report concludes that several organizational forms are more suited than DOE for managing the waste program, including an independent federal agency or commission, a public corporation, and a private corporation.  ;

Among these alternative organizations, the draft report identifies a public  !

corporation as the Panel's preferred alternative, as it best meets criteria the  !

Panel developed for an acceptable waste management organization. The draft also recommends adoption of several specific program components which are independent of the type of organization Congress ultimately chooses to run the program. Foremost among these, the Panel believes an Advisory Siting Council should be established with representatives from all legitimate stakeholders.

.. o DOE ADVISORY PANEL The Chairman has indicated that his consultation to the Secretary on the AMFM study will be limited to an examination of how NRC's regulatory role would be affected by any alternative management proposals. I will forward a final draft of the Panel's report to you as soon as it is available for your assistance in identifying such impacts.
