BRIEFING PAPER 10 CFR 2.206 Petition re Grand Gulf On April 17, 1984, James Lieberman, ELD, forwarded to 0IA for appropriate use a 2.206 Petition submitted by the Jacksonians United for Livable Energy Policies (JULEP). Within its Petition, JULEP requested that the Commission appoint "an independent panel of investigators" from outside the NRC to investigate:

a.

"possible improprieties and illegal acts by NRC inspectors and investigators;"

b.

"the handling by the OIA of the improprieties which have been previously identified;" and c.

"the effectiveness of NRC Region II in fulfilling the mandated responsibility to enforce the regulations of the NRC which exist to a

ensure protection of the public health and safety."

Cynthia Stewart and Ken Lawrence, both members of JULEP, were interviewed in Jackson, Mississippi, on June 28, 1984. One allegation was raised that a member of NRR, in barring Lawrence and another JULEP member from a meeting with the licensee, did so with the excuse that a draft NRC inspection report was being discussed with the licensee. The NRR employee was interviewed on July 18 and it was determined that the " draft inspection reports" discussed 8505100390 841113 LB 5

were licensee inspection reports and not NRC inspection reports. The intervenor was barred because of concern for protection of the license's proprietary information.

Stewart also was concerned about the apparent submittal by the licensee and approval by the NRC of technical specifications for the Mark II containment to satisfy a requirement at Grand Gulf only later for it to be discovered that Grand Gulf doesn't have a Mark 11 containment. Such activity does not contri-bute to public confidence, in her view, and it should be determined how it could happen. This matter has been briefed to the Commission previously by NRR.

No further information or explanation was provided.

It should be noted that, according to 01A records, 0IA has never conducted an investigation concerning Grand Gulf. Secondly, item c., above, which raises the issue of the

" effectiveness of NRC Region II," is not a matter 0IA investigates, i.e., an l

allegation of wrongdoing by NRC employees. Absent information or evidence to l

support an allegation that the perceived ineffectiveness is the result of misconduct by NRC employees, there is no issue of investigative interest.

i In any event, Cynthia Stewart, signer of the Petition on behalf of JULEP, will be interviewed to determine whether she, or others, have any specific informa-t tion which would support an allegation (s) of misconduct on the part of any NPC employee (s).

If such is forthcoming, 01A will then investigate as appropriate.
