of proof which Applicants will make to the Board in this 10 proceeding. Because it is an offer of pr'cof, the deposition 11 will consist solely of direct examination of Mr. Scarbrough 12 and Mr. Ethridge by Applicants.

19 I am associated with the law firm of Vinson & Elkins in 20 Houston. I'm here today representing Mr. Scarbrough and 21 Mr. Ethridge, both panel members, who are Brown & Root 22 employees.

4 Q. Mr. Scarbrough, would you describe the 5 rotating access platform rail, please?

6 BY WITNESS SCARBROUGH:

7 A. It is a series of steel girders that go 8 all the way around the inside of the reactor building 9 that the top crane in the reactor building rotates around 10 on.

11 Q. How wide is the rail?

12 A. I would say it is between 16 to 20 inches 13 wide. .

14 Q. How far from the liner plate is the rail?

15 A. It varies. Probably between four and five 16 feet.

17 Q. How far above the nearest floor elevation 18 is the rail located?

19 A. The nearest floor is elevation 905. It M is about 95 feet.

21 Now, you testified earlier that in March Q.

22 of 1982 your crew was working on the rail. Were they working D on the liner plate?

24 A. Yes.

M Q. Were they preparing the liner plate for

3 'Q. How long had your crew been working on or

4. about the rotating access platform rail?

5- A. I believe we had been up there about a-month.

6 Q. Did your crew use scaffolding in connection 7 with its work?

-8 ~ A. Yes, we had to use scaffolding. You can't 9 reach the liner plate without scaffolding.

10 Q. In other words, a painter cannot paint the

-11 -liner plate simply by standing on the rail.

12 A. No. -

13 Q. Was the scaffolding located between the 14 rail and the wall of the liner?

15 A. Yes.

16 Q. And your crew could not have worked without L17 '

, the scaffolding; is that your testimony?

18 A. No. That's right.

23 A. I was preparing a section of the liner and 24 steel substraight for coatings, primer application.

2 A. We were up right at the rail level or a 3 little bit below it.

4 Q. Were you working on scaffolding?

5 A. Yes.

6 Q. Could you have worked on the liner I'. ate 7 without scaffolding?

8 A. No, sir.

9 Q. Did you finish the job activity that.you 10 have described that morning?

.11 A. Yes.

12 Q. Did you request a QC inspection of that 13 work? ,

23 remember someone telling -- one of my crew members telling 24 me that'they had some liner plate ready for primer.

5 A. Yes, I did.

6 Q. Did you; follow-normal procedure that morning 7 -in requesting the inspection?

8 A. 'Yes.

9 Q. And was that procedure to telephone the 10 lQC inspectors?

11 A. It was.

12 Do you remember who you talked to?

Q.

13 A. No, I don't.

14 Q. Did a QC inspector show up for the inspection 15 that morning?

16 A. No, sir.

17 How long did you wait?

Q.

18 A. Well, we waited all day, really. I waited 19 about an hour before I got in touch with my boss, 20- Jim Brackin, and let him know that we weren't getting QC i

.21 coverage.

22 Where were you while you were waiting for Q.

M the QC inspector?

24 A. I was in the area.

M Were you on the rotating access platform Q.

2 A. Not at all times.

3 Q. Part of the time you were?

4 A. Yes, part of the time I was.

5 Q. Mr. Scarbrough, would you describe the 6 physical access to the rotating access platform rail?

7 A. It is a series of ladders going up the liner.

8 Q. Is there only one ladder that actually goes 9 to the rail itself?

,j 10 A. There's only one means of access to it.

f 11 There's only one series of ladders.

12 Q. Okay. Were you within sight of that ladder 13 during the time that you waited for a QC inspection that 14 morning?

15 A. I was.

16 Q. Mr. Ethridge, where were you wnile you 17 awaited the --

18 Mr. Ethridge, did you await the QC inspection 19 at your work area?

20 BY WITNESS ETHRIDGE:

21 A. Yes, sir.

M Q. How long did you wait?

M A. I'd say.several hours.

24 Q. What did you finally do?

25 A. We moved to another area.

74,513 1 Q. During the period that you waited, did you 2 observe the means of access, the ladder to the rotating 3 access platform rail?

4 A. Yes, sir.

5 Q. During the period that you waited for QC 6 inspection, did you observe Mr. Krolak climb the ladder 7 to take a idok at the rotating access platform rail?

8 A. No, sir.

9 Q. Did you see Mr. Hamilton climb the ladder 10 to observe the rotating access platform rail?

11 A. No.

12 Q. Mr. Scarbrough, during the period that you 13 awaited the QC inspection e did you observe Mr. Krolak 14 climbing the ladder to inspect the rail?

15 BY WITNESS SCARBROUGH:

16 A. No.

17 Q. Did you observe Mr. Hamilton climbing the 18 ladder to inspect the rail?

19 A. No.

N Q. Would you have seen -- Mr.Scarbrough, would 1

21 you have seen either Mr. Krolak or Mr. Hamilton had they 22 climbed the rail?

M A. Yes, I would have.

2' How can you be sure?

25 A. I was waiting on an inspection to be done, I

2 Q. Did you have your eye on the ladder at all l

3 times?

4 A. No, I didn't, not at all times.

5 Q. Is it pcssible that Mr. Krolak could have 6 sneaked up the ladder without your seeing him and sneak 7 back down again?

8 A. No, he couldn't. It is 95 foot of climb 9 straight up, and for a man that's not in perfect shape 10- that's a pretty good climb, and he would stop and rest 11 .cn one of the landincs. It would probably take just about 12 anyone five minutes t.o make the climb.

  • 13 I would have looked and seen had they gone 14 up.

15 Q. Mr. Ethridge, would you have noticed 16 Mr. Hamilton or Mr. Krolak had they climbed the ladder?

17 BY WITNESS ETHRIDGE:

18 A. Yes, sir.

19 Q. Why would you have seen them?

20 ' A-. I was looking for an inspector, waiting i

21 on them, and it is part of my job to make sure that'I was 22 there available.

23 Mr. Scarbrough, prior to the events on the Q.

24 day that you have just described, do you recall Mr. Krclak 25 performing inspections en the rotating access platform rail?

2 A. Yes, I do.

3 Q. Prior to that day, do you recall Mr. Shelton 4 being on the rotating access platform rail?

5 A. Yes.

6 Q. 'fou observed him personally?

7 A. Yes, I did.

8 Q. Mr. Ethridge, prior to the day we've been 9 discussing, did you observe Mr. Krola): on the rotating 10 access platform rail?

11 BY WITNESS ETHRIDGE:

12 A. Yes.

13 Q. Was Mr. Krolak performing inspections?

14 A. Yes.

15 Q. Did Mr. Krolak inspect work that you had 16 performed as a craf tsman?

17 A. Yes.

18 g. prior to that day, did you observe Mr. Shelton 19 on the rotating access platform rail?

A. Yes.

21 Q. Was he performing an inspection?

M A. Yes.

D Q. Was Mr.,Shelton inspecting work that you 24 had performed as a painter?

74,516 t- Q. Mr. Scarbrough, would you describe the safety 2 features for persons working on the rotating access platform 3 rail?

4 BY WITNESS SCARBROUGH:

5 A. Yes. Everyone of them that worked at that 6 elevation wears a safety belt and a lanyard with a safety 7 belt. Going all the way around the reactor is a steel 15 - cable that's attached to the liner plate by about a three-9 foot support. It stands out about arm's height and is

, 10 within. arm's length-of anyone standing on the rail, and 11 they attach their lanyard to that cable.

12 Q. To hook onto the rail, does a person have

--13 to lean over? ,

14 A. No.

15 Q. Mr. Ethridge, during the time that you worked to on the rotating access platform rail, did you ever observe 17 oil-or greasc on the rail?

18 BY WITNESS ETHRIDGE:

19 A. .Yes, on occasion.

lE Q. How frequently would you say?

! 21 A. Very occasionally.

Et Q. What did you do when you saw oil or grease El on:the rail? ,

24 A. We'd clean it up.

I 26 Q. Why did you clean it up?

74,517 1 A. Safety reasons. We had to work up there.

2 .So it was to our benefit to clean anything up.

3 Q. You wanted it to be as safe as possible?

4 A. Yes.

5 Q. Did you have any particular responsibilities 6 regarding safety at that time?

7 A. Yes. I was a member of the craft safety 8 committee. I was responsible for safety related items.

9 Q. As part of your duties as a member of the 10 safety committee, did you urge those in your crew and the 11 paint department generally to make sure that there was 12 no oil, grease, or foreign matters on the rail for people 13 working there? ,

14 A. Yes, sir.

15 Q. And did you instruct them that if they saw 16 such foreign matter they were to clean it up immediately?

17 A. Yes, sir.

18 Q. On the morning that you have described on 19 the day that Mr. Shelton, Mr. Hamilton and Mr. Krolak were 20 terminated, do you recall seeing oil or grease on the rail?

21 A. No, sir.

22 Q. Mr. Scarbrough, did you instruct members M of your crew that they,were to keep the rail clean at all 24 times?

4 A. For their safety. That was my responsibility 5 for them to have a safe work area.
