On September 14, 1983 the County received the following response from LILCO:

LILCO objects to Suffolk County's Interrogatory to LILCO on the grounds that it is overly broad, un-duly burdensome, seeks information that is not rele-vant and is not reasonably calculated to lead to the discovery of admissible evidence, and seeks informa-tion in a form different from that maintained by LILCO in the ordinary course of its business. With-out waiving its prior objections, LILCO further objects on the grounds that subparts 5, 6, 7, 8 and 9 seek confidential information constituting an invasion of the privacy of the LILCO employees who are LERO workers. Without waiving its objections with respect to subpart 4, LILCO states that OPIP 2.1.1 states, by LERO job title, whether the employee with that title should report to the EOC, to staging areas or to relocation centers. There has been no further definition of reporting locations. Without waiving its objections with respect to subpart 3, LILCO states that Figure 3.3.6 in the Plan lists by LERO job title personnel who will be notified by pager; the remaining personnel will be notified by telephone.

With respect to subpart 10, LILCO will provide to Suffolk County, under separate cover, a listing of i

the residential zip codes of LILCO employees who are LERO workers.

Pursuant to 10 CFR S2.740 (f) , Suffolk County hereby seeks a Board Order compelling LILCO to respond to subparts 1, 2, 5, 6, 7, 8 and 9 of this Interrogatory.

LILCO's objections to this Interrogatory do not justify its refusal to provide the requested information. The request is not, as LILCO asserts, " overly broad." It seeks specific data with respect to the individuals already identified by LILCO. An objection that a discovery request is " unduly burden-some," without a demonstration and a showing that the alleged burden outweighs the right of the requesting party to obtain the information, is not sufficient to justify a refusal to respond to a discovery request. See, e.g., Prehearing Conference Order (Phase I -- Emergency Planning) , dated July 27, 1982, at 24 ("the Board does not believe that a request for documents should be deemed objectionable solely because there might be some burden attendant to its production").

It is clear that the requested information is relevant.

The LILCO Plan is dependent for implementation upon the ability I

and willingness of approximately 1600 LILCO employees to report in a timely manner to perform various emergency functions to which they have been assigned. Each of the employees which have been designated by LILCO to fulfill positions in the LERO organization also has a regular LILCO position, as well as other responsibilities not related to his or her employment.

The Board has admitted contentions concerning timely notifica-tion and mobilization of LERO workers (Contentions 26 and 27) and concerning role conflict (Contention 25) . Part 2 of the County's Interrogatory seeks information directly related to the notification and mobilization issues. Similarly, as noted in Contention 25, one of the most common reasons that emergency workers fail to perform their emergency functions promptly, or at all, is the normal human desire to attend first to the needs of one's own family in the event of an emergency. Parts 1 and 5-9 of the County's Interrogatory seek factual data that are necessary for an informed evaluation of the conflicts likely to be experienced, and the likely reactions to those conflicts by the LERO workers. Thus, all the information requested in the Interrogatory cle.arly is relevant to admitted contentions.

Indeed, the data are essential to an informed evaluation of the ability of LILCO's employee-staffed LERO to implement the LILCO Plan in the event of an emergency at Shoreham.

LILCO's objection that the interrogatory seeks information "in a form different from that maintained by LILCO in the or-i dinary course of its business" is not a legitimate objection to an interrogatory. Under some circumstances, this could be an appropriate objection to a document request; parties are not required to create specified documents in a given form l even if a discovery request seeks such documents. Such an argument, however, is simply inapposite here. The County's

interrogatory seeks data, not a particular document. The County did not specify how or in what form the data are pro-vided by LILCO; what is desired is the information. It is further significant that LILCO's objection is not that it does not possess the requested information. Indeed, it would be surprising if LILCO did not possess the requested informa-tion, since the individuals in question are all LILCO employees upon whom LILCO intends to rely for implementation of its Plan.

Finally, the County disagrees with LILCO's assertion that parts 5-9 of the Interrogatory " seek confidential information constituting an invasion of privacy" of the LERO workers.

First, the County has not sought the identification by name of the individual LILCO employees who are also LERO workers; similarly, in most cases the LILCO job titles identified by LILCO are not such that one could easily pinpoint particular individuals (see printout excerpts attached to Appendix 1) .

Thus, a considerable amount of " anonymity" would continue to protect the " privacy" of the LERO workers even if the re-quested information were provided. Second, the County submits that neither the sex of an employee nor the information con-cerning marital status and number and ages of children is information that, in litigation, is normally considered " con-fidential" or entitled to special protection.

Third and most important, the information sought is central to admitted issues in contention in this proceeding.

This Board cannot evaluate whether the persons relied upon under the LILCO Plan will or will not experience role conflict without factual information and hard data on that subject.

Right now, LILCO is the only party in possession of the family responsibilities data that are central to the' role conflict issue. / LILCO should not be permitted to withhold this in-formation from the County and the Board, particularly in light of its own claim that its workers will not experience role conflict.

In conclusion, in light of the fact that LILCO's employees are in the middle of this litigation by constituting the off-site response force, LILCO cannot now be heard to complain

, about discovery requests concerning the abilities of those workers actually to perform the tasks assigned to them by LILCO. The County submits that LILCO should be compelled to

respond fully to this Interrogatory.
