Dear Mr. Stolz:

This is in response to your letter dated March 11, 1983, (Log No. 1241),

which accompanied Amendment No. 55 to Facility Operating License No. NPF-3 for the Davis-Besse Nuclear Power Station.

We agree with the deletion of those sections in Appendix B, Environmental Technical Specifications, which pertain to nonradiological water quality related requirements. As a result of this amendment, only Sections 3.1.2.b, 4.1, and 5.4.1 Part A, remain.

Your letter stated that the NRC staff still wishes to remain informed about any changes in the Davis-Besse National Pollutant Discharge Elimination System (NPDES) permit and any violations of this permit. You requested that this information be submitted to the Region III Director and the Director, Office of Nuclear Reactor Regulation.

By way of information, the NRC Resident Inspector is routinely copied on the Monthly NPDES Reports, reports of unauthorized discharges, and reports of noncompliance with discharge limits. Toledo Edison will, in the future, also provide a copy of the Monthly NPDES Reports, reports of unauthorized discharges, and reports of noncompliance with lischarge limits to the Office of Nuclear Reactor Regulation.

Because these are for information only report copies, they will be sent non-docketed to the NRC.

By filing the information in this manner, the NRC can have cognizance of all formal transmittals between us and the Environmental Protection Agency.

Of course, Toledo Edison responds only to the Environmental Protection Agency reviews in these matters. This Agency is firmly identified as the c

only reviewing regulatory authority by the 1972 Amendments to the Federal Water Pollution Control (Water) Act.
