SUBJECT:

FLORIDA /ST. LUCIE - EMERGENCY PLANNING CONCERNS I.

INTRODUCTION As we had discussed, the following documents a sumary of background informa-tion and concerns relative to the status of emergency planning in the State of Florida (and specifically with respect to FP&L's St. Lucie facility) and intended courses of action.

Providing this infonnatipn will serve to elevate the awareness level of potential problems which could arise in Florida in the near tenn.

II.

EXERCISES As of this writing. Florida is scheduled to participate in three major full-(.

scale exercises prior to April 1,1982.

Specifically, the dates _ are as -

follows:

February 10-13, 1982:

St. Lucie March 15-18. 1982:

Turkey Point March 29-April 1,1982:

Crystal River This is a rather optimistic schedule and with the current status of the State plan. I personally question whether this schedule can be met.

III.

STATUS __0_F STATE PLAN FEMA IV and the membership of the Regional Assistance Comittee (RAC) have met with Florida officials on numerous occasions during the past eighteen calendar months and have offered assistance as necessary to expedite the

' planning process on the State plan.

The RAC's most recent meeting to again review. the State plan was on December 15 and 16,1981.

The results of this review indicate that there are still si9nificant concerns in the plan which require resolution.

FEMA IV transmitted these concerns to Governor. Graham on December 29, 1931.

Following up on the December 29 letter to Florida. the undersigned and the Chairean of RAC IV met with the State of Florida officials on January 8,1982.;

to discuss our concerns.

The State was receptive to the RAC's conments and

Hence, FEMA IV is in a potentially.sensi-

.ive situatioh with the State since the State will be undertaking three ajor exercises with a plan which is still under review and has not been

'ndorsed by the membership of the RAC.

This is a departure from tradition.

Q'e Regional State Liaison Office and the Chairman of RAC IV met with Florida fficials on January 8,1982, to discuss the status of the plan and other

ssues related to the State of Florida /St. Lucie exercise.

The State was eceptive to the RAC's coinrents and agreed to make the necessary revisions.

TPER SIGNIFICANT ISSUES - ST. LUCIE St. Lucie County Petition i

[A April 3,1981, the County of St. Lucie petitioned the NRC (Harold

. ton) and FEMA National.

The substance of this petition requested

\\....d and FEMA to require FP&L to fund the following:

1.

A new bridge connecting Hutchinson Island with the mainland

(estimated cost $40 million):

2.

A new County EOC located at the periphery of the 10 mile EPZ:

i 3.

Construction of a fire station, and associated equipment, on FP&L property; - --

4.

Procurement and installation of the early warning and notifica-tion system, to include. maintenance; 5.

Publication and distribution of public infonnational brochures; and.

6.

Provisions to test the Utility, State and local government emergency plans by means of periodic full field exercises.

FEMA responded to this petition and essentially stated that in the cbscnce of a State plan and subsequent test, 7 this time.

via a major full field exercise, this request could not be supported Addi-tionally, FEMA noted that they have no jurisdiction over FP8L.

City of Port St.1.pcie Petition On May 4,1981, the City of Port St. Lucie petitioned NRC (Chairman Ahrarne).-

This petition requested that NRC direct FP&L to provide retroactive c.ompensation (lower electric bills) for all persons residing in the primary fallout area of the St. Lucie Facility.

(NOTE:

The primary fallout area is not defined in the resolution, but is assumed to be synonymous with the 10 mile EPZ),

The peti-tion also requested that NRC conduct a hearing in order that the resolution be heard and resolved.

.I am not aware of any msponse or action by NRC to this petition.

We should focus attention on this.

h Early Warning and Notification Systeq FP&L is currontly in the process of installing an early warning and

notific.ation system in the environs of St. Lucie.

The Civil Defense di rector of St. Lucie County, Phillip Rodi. called me on September 23, 1981. to express the following concerns.

f' FP&L chose to ignore St. Lucie County, and has been dealing x

directly with the State relative to the early warning and notification system.

2.

Although FP&L has agreed to pmcure and install the system (59 sirens). FP&L has told the State they will provide funding in the amount of $200/ siren / year for maintenance.

The State felt that this was equitable.

3.

The County's concerns are as follows:

(a)

The system will become County property when it is turned over to the County by the State.

All County equipment must be insured. -

(b)

The County feels that $200/ siren / year will not adequately cover insurance, vandalism, naplacement and maintenance.

R2di has the support of the County Comissioners, and he indicated that the County will not sign off on the St. Lucie County portion of the State plan until this matter is equitably resolved.

To my knowledge, and FEMA IV, this matter has not been resolved.

Wa should make sure FP&L is aware of the prvblem, and if they're not

Tha Emergency Preparedness Section Chief, G. R. Jenkins, and the under-signed discussed this issue with FP&L (H. Johnson) on January 4,1982.

During this discussion. FP&L indicated that a meeting was scheduled for January 11-12; 1982, with the St. Lucie County Cornissioners to discuss a. revised three party contract dealing with the early Warning and notification system.

FP&L advised NRC on January 13. 1982. that St. Lucie County agreed with the contract and that the Comnissioners were expected to officially sign it during the week of January 18.

The fact that St. Lucie County has approved the contractual arrangements for the early warning and notification system is encouraging and. hope-fully, is indicativo of a spirit of cooperation on their part.

However, tha actions of the County imaediately before and during the upcoming majer exercise are still considered to be unpredictable.

The State shares these sane concerns and has agreed to advise FEMA IV inraediately of cny infonnation which would indicate that St. Lucie County does not war.t to. participate in the exercise scheduled for February 10. 1982.
