XCOM-1051, EXPORT OF NUCLEAR COMP 0NENTS TO ARGENTINA (EMBALSE-1)
We have reviewed the subject export and provide the following international safeguards information for your consideration.
Argentina is neither a party to the Non-Proliferation Treaty nor the Tlatelolco Treaty and, to our knowledge, has no full-scope safeguards commitments.
Information available to staff indicates that Argentina has some nuclear facilities operating outside of IAEA safeguards at this time.
Argentina has INFCIRC/65-type agreements providing IAEA safeguards coverage for many of its nuclear facilities, including the Embalse-1 power reactor.
IAEA safe-guards coverage on all source and special nuclear materials used, produced, or substituted for at Embalse-1 is provided through the IAEA safeguards agreement referred to as INFCIRC/224. This safeguards coverage appears to satisfy 10 CFR Part 110.42(b)(1) requirenents which are applicable to this license submittal.
The latest IAEA Annual Report shows that an IAEA Facility Attachment for Embalse-1 is under negotiation, but not yet in force. We understand, however, that the IAEA routinely inspects Embalse-1.
The IAEA Annual Report states that "... the Secretariat... did not detect any event which would indicate the diversion of a significant amount of safeguarded nuclear material....
It is considered reasonable to conclude that the nuclear material under Agency safeguards in 1989 remained in peaceful nuclear activities or was otherwise adequately accounted for."
There are no physical protection requirements applicable to the subject export.

Enclosed please find an application from Hoke Incorporated for a license to export replacement valves to the Embalse Nuclear Power Plant in Argentina.
The valves initially will be shipped to Hoke Controls Ltd. in Canada and transferred to the Atomic Energy of Canada Ltd. before reexporting to Argentina.
Before taking action on this request, we would appreciate your obtaining the necessary assurances under Section 109 of the Act and receiving your views from the overall perspective of the Executive Branch, as to whether the proposed export meets the other applicable criteria in the Atomic Energy Act of 1954 as amended by the Nuclear Nonproliferation Act of 1978.
