The NRC staff and the licerisee have both filed responses opposing the request on the basis that

On August 24, 1981, Mr. Jaffer filed a petition for
\\'
l review of the Licensing Board decision _ to permit the repair of the Turkey Point steam generators together with a motion to proceed h forma pauperis.
The motion to file in forma pauperis-was denied by.the D.C.
Circuit Court of Appeals.on_ October 2, 1981, for lack of. standing.
Mr. Jaf fer also filed a motion to file an amicus curiae brief with the Appeal Board on the pending appeal in the steam generator proceeding,-
which was denied in an order dated October 9, 1981.-
In any event, the order relating to the steam generator repair is a separate action unrelated to the TMI Action Plan order, and does not affect the request for'a j
hearing.
