Inspection Nos. 80-33, 80-26

This refers to the routine inspection conducted by A. R. Blough and C. J.

Ccwgill at Peach Bc: tom Atomic Pcwer Station, Units 2 and 3, Celta,

Pennsylvania of this office on November 8 - 30, 1980 of activities authorized by

NRC License Nos. OPR-44 and OPR-56 and to the discussions of our findings held

by Mr. Cowgill with Mr. W. T. Ullrich of ycur staff at the conclu., ion of the

inspection.

Areas examined during this inspection are described in the Office of Inspection

-

and Enforcement Inspection Aeport which is enclosed with this letter.

Within

these areas, the inspect. .n consisted of selective examinations of procedures

and representative records, interviews with personnel, measurements made by the

inspector, and observations by the inspector.

Our inspector also verified the steps you have taken to correct the item of

nonccmpliance brought to your attention in the enclosure to our letter dated

June 30, 1978. We have no further questions regarding your action at this time.

Based on the results of this inspection, it appears that certain of your activi-

ties were not conducted in fuil compliance with NRC requirements as set forth in

the Notice of Violation, enclosed herewith as Appendix A.

These items of

noncompliance haie been categorized into the levels described in the Federal

Register Notice 45 FR 66754) dated October 7,1980.

In addition to the need

for corrective action regarding these specific items of noncompliance, we are

concerned about the implementation of your management control systems that

permitted them to occue.

Consequently, in your reply, you should describe in

particular, those actions taken or planned to improve the effectiveness of your

management control systems.

Item A of Appendix B in the Notice of Violaticn enclosed with this letter was

identified during previous inspections of your licensed activities on March 1 -

March 31 and September 1 - Septe-ber 30, 1980 and were documented in the enclosure

to our letters dated September 24 and Oc cber 30, 1980. Your letter to this

office dated November 19, 1980 stated the occurrence was the result of personnel

error and that you re-instructed the individuals concerned regarding escort

requi rements .

From our November 7 to November 30 inspection it appears ti:at the

stated corrective actions were not effective since this item has recurred.

Recurrent items of noncompliance are given additional weight in the considera-

tion and selection of appropriate enforcement action.

Therefore, in your

response to this letter, you should give particular attention to those actions

taken or planned to ensure that identified items of noncompliance will be

completely corrected and will not recur.

In accordance with Section 2.790(d) of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, documentation of findings of your control

and accounting procedures for safeguarding special nuclear materials and ycur

facility security measures for physical protection are deemed to be commercial

or financial information within the meaning of 10 CFR 9.5(a)(4) and shall be

subject to disclcsure only in accordance with the provisions of 10 CFR 9.12;

therefore, the pertinent section of the enclosed inspection report and Appendix

B, will not be placed in the Public Document Room and will receive limited

distribution.
