This letter is provided to suppl (cent our letter of April 23, 1980 which requestec deletion of all ncn-radiological Envircr: mental Technical Specifica ions (ETS). B is request was made based on the premise that this area was outside of the NRC's jurisdiction and was adequately ar.a more appropriat rly regulated by the U.S. Envirormental Protection Agency National Pollutant Discharge Elimination System (NPDES), and the State of Florida's Department of Environmental Regulation. Bis position is, of course, supported t'y the " Yellow Creek" decision regarding imposition of such requirements on Tennessee Valley Authority's Yellow Creek Nuclear Station. We remain adtraant in our conviction that this should be swiftly spplied to all licensees and urge expeditiour ccepletion of licensing actions toward this end.
It is our understanding that part of the delay in acting on this request may be a result of the Staff's efforts toward assuring that the Cecnission is adequately informed of envirormental effects or nuclear plants. It should be noted that the Crystal River NPDES, as well as all such permits that we are aware of, require that all reports be transmitted to the NRC. B is would l
appear to satisfy this concern.
However, a more pressing need has now arisen in this area. One of our monitoring points, designated as " Test Well #",
is no longer available. Re State of Flcrida has approved deletion of this requirement from the applicable permit (s). We are in a positien where compliance with cur license is, in this isolated case, impracticable. We therefore request deletion of the reference to Test Well 4 frca ETS 3 1.5 Moreover, we request. ' hat this deletion be processed i:=ediately.

No. 40, submitted on May 23,1979 (over 14 months ago) be granted as well.
This change simply corrects an earlier oversight in the drafting of the ETS.
The NPCES pennit, as written, allows FPC to detennine that an emergency need for power exists. This provision was not included in the ETS.
Once again, FPC would urge that Change Request No. 61 be granted, thereby deleting the duplication between NPDES and the ETS. Failing this, we would request imediate action on the two requests outlined above.
