By application dated May 20, 1980, you submitted to the Office of Nuclear Reactor Regulation (ONRR) for review proposed Technical Specification changes to Millstone Unit No. 2 relating to automatic initiation of auxiliary feedwater.

No fee pursuant to 10 CFR 170 was remitted because your Company considered the Class IV fee paid for your May 9, 1980 Cycle 4 reload request to be applicable to the May 20 application. You also stated that the CNRR staff advised you of their intent to issue the auxiliary feedwater changes in conjunction with the reload.

Based on information recently provided by the ONRR staff as a result of a preliminary review of the May 20 application, it has been determined that this application involves consideration of a single safety issue requiring an independent review from that for the reload application. As such, the May 20 application requires a Class III fee of $4,000. Although the ONRR staff might elect to consolidate more than one application into a single license amendment issuance with a single Safety Evaluation, it does not mean that each application did not require and receive an independent review and analysis. Also, if an initial application is subsequently modified / supplemented to include changes that were not the subject of the initial application and the changes require a separate independent review and evaluation, the modification and/or supplement is considered an additional application requiring an additional fee, or the proposed changes could cause the fee for the initial application to be changed to a higher fee class.

In view of the above, it is requested that your Company remit a Class III fee of $4,000 to this office for your May 20 appitcation. -If the final review of your application by the ONRR staff reveals that this fee is incorrect, an adjustment will be made.
